Its long, so if you cant be arsed to read its basically Drag 1-0 Audio joint (Bonce has no choice but to read )

Anyway...

Last week, as you know, El 'Beast went for his MOT. As part of the service, Bruce the Builder did a thorough check inside and out and discovered something. In his words "the last person who had these seats out, needs to be shot"

It turns out, that the last person to have the seats out, had lost the little T-bar pieces keeping the seats firmly in place. Obviously they are important, but i hadnt noticed (my seat didnt move). Also, they had placed the Screws/bolts in the wrong holes (Big ones in little holes and vice versa).

The result of the mix-up was that they "pushed through" to the bottom of the car (with the big bolts) so there is a tiny hole underneath El 'Beast.

I asked Bruce "is it serious/long term damage?" To which he said "Nah, but it could leak". He quoted me £20-£30 for a repair which will be done when i get time and he is free .

So. who had the seats out last? The audio place that fitted the Base-tube! But it was done in August, so how i could get them to pay for their damage?

I went about a plan I rang them up on Monday with my consumer law textbook to hand, and this is what was roughly said:

Drag(D): Hello can i speak to the boss please?

Audio Joint(AJ): Certainly sir, i'll just see if he's in. Can i ask what this is about?

D: no.

*Waits a minute or two*

AJ: Hello, this is **** *****, how can i help?

D: Good morning, i have a slight problem. Do you remember my elise, that you fitted a base-tube to in August?

AJ: Yes. I remember the technician having many difficulties getting in and out.


D: Yes, i guess it was difficult getting the seats in and out as well?

AJ: Yes it was!

*got you now, you er

AJ: What exactly is the problem?


D: My car has just gone for its service and it has been discovered that the last person to have had the seats out, has put the bolts in the wrong place, causing a hole in the bottom, and lost a few pieces. The repair and replacement parts is going to cost £120.00 plus Vat (), at a Lotus specialist. Who do you think should pay this?

*Cheeky i know, but they shouldn't have with El 'beast. Plus, you cant beat a bit of profit*

AJ: ...erm, are you suggesting that we lost those pieces and caused those holes? Are you suggesting we should pay? Those could have been there before or done afterwards.

D: yes. it was you. You've already told me you took the seats out, and i can guarantee that nobody else worked on it afterwards.

AJ: well its your word against ours, then. Im sorry i cant be of more assistance...

*major bullshit begins*

D: Wait there! My car is kept in a warehouse for storage purposes throughout the winter. This warehouse is an official Lotus scheme, whereby technicians have the wheels raised off the ground with a battery conditioner and the car is started every couple of weeks for 10-15 mintues and then put to rest again.

AJ: and?

D: Ah well, my car was picked up by Lotus UK, 2 days after you fitted the tube. it has remained there since and these "holes" were discovered while a service was carried out at the warehouse. I have all the correct documentation showing the date of pick-up and storage since.

Therefore nobody has worked inside the car, and certaintly not removed the seats.

Even if they did, do you think they would be THAT incompetant?() If it was them, why would they tell me? As if im going to notice to tiny holes underneath.

*couldnt resist that slight jab*

AJ:[silence]

D: Further, before the car is delivered to me, in late july, essentially the same check is carried out. If those holes were there before, they would have spotted them, just like they have now. It was clearly you, and i can prove it. As i say i have the correct documentation, that i can fax to you if you wish?

*Critical point: he could have called my bluff*

AJ: [silence]

D: who should pay for it?

AJ: Im still not convinced.

D: Fine. I will carry out a full engineers report and instead of having it repaired at a specialist, it will be done at the factory which increases the cost greatly.

Then when i take you to court, you will lose and pay all my costs, the increased cost of repair and a full engineers report.

*I then went on about the sale and supply of services act and various consumer legislation for 5 minutes*

Please could you give me the name of your solicitor so i can forward all the relevant documentation. Being a solicitor myself ( ) i'll sought this out in my spare time. His name and number?

*twat didnt know what hit 'em*

AJ:...erm. How much was it again?

*i forgot what i said*

D: £120+Vat.
Have you got a pen?

AJ:.....

D: Good! Make the cheque out to Mr...... My address is ....... ......

*In a really swarmy, gloaty voice i said*

Have you got that?

AJ: ......

D: Ok then, Byyyyyyeeeeee

*and out the phone down*

Today i received a cheque for £140. Is that right (+vat?)

So. I made £110 for making a phone call.

Therefore, im placing myself on the shortlist for the annual "king-ding-aling" award

Right. im off to buy some hookers and a vat of baby-oil

I believe the correct charge is obtaining a pecuniary interest/advantage by deception (under the theft act)

Or possibly obtaining a money-transfer after the debacle of Gomez and the mortgage cases!

Things are looking good though! My coursework mark was 72%

Ok! i guess i should explain the reason i am an alki!
At the tender age of 17 i left collage to join her magasties police force....after being stitched up by a young scally for beating him senceless i decided to persue a career in law........
After 2 weeks at law skool and passin all my thingies at super level i am no a kwalified law thingy!
i get disbarred for ing in the comunal rest rooms...

so there is the sad story of my life up to this point...
dragstar we obviously have things in common....and so i suggest next time i get a ticket for "undue care and attention"!! like they no how much care and attention goes into a power slide round the A414 round about you being the newly thingied watsitsname get me of my charge...or i may feel obliged to send this post to higher waffer at judge HQ!!

Drag....Isn't bolt going through the chassis or mis-threading considered chassis damage and thus a write off ???

Possibly Malborn.

But Bruce said it wasnt serious. If it went through the Chassis, he would have said so.

When i said "gone right through" and "hole in the bottom" perhaps it was just a floor pan

Just like the corrosion area, its not on a load bearing area so i assume a hole there is also non-serious.

Just have to wait and see. If it is a write-off. then ill be back on the

I dont really think he was over charged:

Repair bill-..........................£30
1/2 solicitor fee at £220/hr-.£110
Total-..............................£140

He cant really agrue with that as I think you charged him a modest rate!!! LOL
