Hold out for that personal injury claim and start thinking of upgrades!

Not the thickest of silver linings, but you've gotta take them where you can!

If you don't have a personal injury please don't make a false claim, this kind of pikeyness is driving up insurance costs for everyone and that level of dishonesty is disgusting. You have a disgraceful attitude Wendy.

Sorry to hear about your car though mate. At least you are ok, and with any luck the bitch will get done for careless driving etc. making the roads safer for us all. Given how long lotus can take to supply parts, you may be better off with a write off anyway.

It's no wonder we're all paying silly premiums with muppets like this about. Why claim if there's nothing wrong with you?

Mav, really sorry to hear about your car. Know how you feel, I had a woman in a Kia off-roader reverse onto the front of my car in stationary traffic on Monday night. Only had the car back a month since last time someone hit the car. Identical damage both times. Still driveable thankfully but car looks like it has a bloody nose again. Well p*ssed off.

Rubbish! The way insurance pay out will be for a trade in value which is generally far less than the value of the car. You will never see the value of the car even though you are completly innocent. If you have been to A&E (and if there is any type of accident, I would make my first stop to A&E) Without a doubt put in an injury claim.

Also if this woman has done this once it is an accident, twice in a short space of time is stupidity and she should be removed from the road before she really hurts someone seriously. Driving up her insurance may mean she has to get her incompetant backside off the road.

Even minor whiplash takes a few days to manifest and can make your life hell for years. My next stop would be a very good chiropractor and charge it to her insurance.

My wife suffered a similar injury over 5 years ago and we spent 3 years going back to the chiropractor. At £35 a treatment the idiot who caused the injury can pay. In the end we had a nice holiday from the payout which is far less than she deserved for all the pain caused.

The payouts are carefully adjusted on an agreed scale and you will not get more than you deserve.

I have 8 years no claims (touch wood) but the last accident I had was my fault, I took the passangers to A&E straight away and made sure they claimed against me. For a few years, I had to pay a huge amount in insurance but my friends were happy and taken care of.

I agree with Wendy - get that claim in there!!!

I've been waiting years to get something back out of my insurance!!

The whole system is a joke anyway....I could have genuine whiplash but how would that compare over the variety of other ailments I have sustined playing rugby for 19 years and which I sustain voluntarily?

Be careful - Wendy's post wasn't suggesting a fraudulent claim as he had already said that he had sustained whiplash.

Someone obviously didn't bother reading her post properly......

If you want something to winge about - here you go:

"I recommend that you make a claim anyway - EVEN IF YOU HAVEN'T SUSTAINED WHIPLASH".

(I am not a personal injury lawyer or a litigator by the way).

I just think that good drivers fork out high insurance premiums year after year to help finance those who aren't so good. If you get the opportunity to claim - I certainly would!!!!!

F*ck them.

Doh!- It won't simply put the blind woman's insurance up, it affects all our premiums. Insurance companies use the premiums of those that don't claim to pay for those that do- it's not rocket science. If the average claim cost goes up, so do premiums.
Don't claim if you don't need to- if the full cost isn't recovered by your insurer, your premium will go up and then who will feel silly?

An injury claim, valid or not is the ONLY way to recoup the value of the car. The payout for the car alone will only be to the trade in value NOT the replacement value. It is the only way to win or at least not make a loss because of this stupid woman.

If you can make a claim then I would claim.

I appreciate that it puts all our premiums up but premiums are so high anyway I've stopped caring.

There's two arguments on an insurance related subject:

1. Lotus drivers should be risk adverse and therefore help lower the premiums on Lotus cars.

2. Lotus drivers should just claim as normal. Lowering the premiums makes the cars more accessable to chavs which would raise the claim rate anyway.

To those interested the supposed "compensation culture" is a myth. Driven by the media and insurance companies the same, I refer you all to the "Better Routes to Redress" document which indicates that in our industry whilst there are no doubt a number of unscrupulous operators attempting to attract/manufacture claims by any means necessary, in practice very few of these claims see the light of day and are not pursued. Facts show that the actual number of claims has remained level for a number of years with only slight fluctuations in both reduction and increase, certainly nothing untoward.

My company specialises in non-fault accident management and more often than not actually saves insurance companies money than costs them money. We do this by being far more pro-active than insurers and reaching resolutions far quicker than they can achieve.

I am more than happy to discuss this with any PHer who wishes to know more. If you care to PM me, I will email you my number back to discuss.

To those who say to a genuine claimant that he shouldn't claim as it might drive your insurance premium up, I say you don't know what you are talking about.

All the best

Steve

Hmm. It seems Ive inadvertantly opened a can of worms! My neck and back or very sore and I rely on functioning properly as I am a professional singer/actor/musician. Should I have any problems then I will put in a claim, but because of the nature of my work and some of the figures involved it could become crazy! I'll see what is said about the car and then decide. It was (like all of you here) my pride and joy with loads of upgrades which would not be recouperated if it was a write off. I wouldnt want a second hand one as it sort of takes the shine off saving for years to afford a new one. We shall see...

Absolutely agree- if the claimant is genuinely injured, no problem in putting in a claim- you're entitled to it. It's the 'claim anyway' attitude that I can't swallow- it's fraud too. I know I'd be upset if I hit someone and they claimed against my policy when they weren't genuinely injured.

maverick25 - I strongly suggest you contact Steve (anniesdad) as posted above.

He helped me when my car got written off back in May and made the whole sorry episode much less painful. At least talk to him for advice. Before Steve began helping me out the whole thing was turning into a right nightmare - Steve took the matter in hand, resolved all the issues on my behlaf and had a solicitor helping me claim back my (fair) uninsured losses.

I agree with DanH that you should not make a false or unfair claim, but you do have a right to ensure that ALL your losses are mitigated in a situation which was 100% someone elses fault.

Rightly or wrongly, you have been hugely inconvenienced and need to ensure that you are adequately compensated. Beware of whiplash/back injuries. Since May mine are still not fully resolved, despite physio and visiting my GP and a specialist. Seek professional advice and make sure you're looked after, especially where your career is concerned.

Best of luck, I hope it all works out OK for you.

Regards, Tim
