Notarie Issues
Discussion
I was wondering if anyone can help at all.
So for the past year I've been selling our home in France & last January we where told a document would be sent to the UK to make sure me and my brother where the only surviving successors to the estate as mum and dad passed away. 6 months later no word so as I was over I went in but got no where and wouldnt see me.
The property was my parents who are no longer alive and so its been left to me and my brother, He lives in Australia so isnt going to comeback to sign anything. The notarie put a document in place and he signed it to say i can sign on his behalf so wouldn't be any issues.
Fast forward to October we had agreed to complete as everything was completed but the notaries decided to shut for 3 weeks so this delayed it yet again.
Finally after agreeing a final date in December I made my way over to remove the final items from the property & sign everything over to the new owners. We all went to the notaries to be asked where my brother was............ Well he is in Australia as you know.
Apparently this was a issue and the document he signed wasn't worth anything, she just made everything a issue. After 2 hours I signed everything I had to and she agreed to complete the sale upon him scanning and sending a document back with his signature on and a statement written. He would have to also post this but the completion would be on the scanned copy as proof. Fine no problem.
She also then checked our bank details and said his are wrong........... They where not as I use them to send money to him for xmas and birthdays etc again this was an issue for her. I left and cameback to the UK without a thought as it was completing on the 30th.
Come 30/12/19 The document arrived from Australia and a spare copy to a family friend who had been helping me through out as my French is terrible, also she lives local. Completes fantastic all done and dusted.
Fast forward to 09/01/2020 2 weeks after the sale completed I still have NO funds in my French bank account and no contact from the notaries despite emails, calls etc. My friend has been in 8/01/2020 only to be told they cant send funds to Australia & he has to sign a document to send all the funds to me which they will email to him and our friend so she cant translate.
Still no reply to me the Seller & if we hadn't got anyone to go in I would be none the wiser, Until I get documents I am still paying house insurance etc and cant cancel it it seems so I am paying for a house I dont own while she gets interest off our money. Still no letter from them for my brother and I bet we will have to get our friend to go in again at this rate.
She has been a nightmare throughout everything and i would like to report her to someone higher or a ombusman etc if they have one can anyone advise at all? I'm getting more and more angry over her incompetence as they all seem scared of her at the office so wont help.
Any help would be fantastic & the Notaire is in Noyant if that helps?

I had a slight problem with notaires keeping hold of my money on both occasions I've sold property in france , so have a couple of other people I know , but also know people who got paid straight out .
The first time it took a few weeks of hassling them before the payment came through but I had returned to England , the second time I was ready for it and stayed on in france in a hotel and visited the notaire every day to insist the payment was made , it still took a few days for something they could have done with the press of a key on the day of the sale . I've no idea why they do it but good luck , I'm sure it'll work itself out soon .
Also be sure to cancel your house insurance by registered signed for post and include the paperwork that your notaire will supply you with to enable cancellation. You should also get a letter for your bank to explain where the funds have come from and what they are for .

Thanks Paul. I've sent my local friend over and the notaire "isnt in" so going back tomorrow. Me & my brother are emailing daily now yet to get a response or any paperwork. The buyer is sending me the document to cancel the insurance to speed it up though thankfully. The first time it took a few weeks of hassling them before the payment came through but I had returned to England , the second time I was ready for it and stayed on in france in a hotel and visited the notaire every day to insist the payment was made , it still took a few days for something they could have done with the press of a key on the day of the sale . It’s good that she has finally sent the money to you both.I've still no paperwork or a bill for the costs that shes taken from the money without permission but sod it, have my money now she can rot in hell.
She will probably send the documentation by snail-mail. Gives you a chance to calm down.

What costs ? you may have a couple of extra small costs due to the Australian connection but the buyer pays all fees connected to the house purchase apart from a coupe of odds and ends that your liable for , I can't actually remember exactly what they're for but they shouldn't total much , I think mine were a couple of hundred euros . It's a bit cheeky for her to send the funds to a foreign bank account directly, I kept my French account open so they could deposit the money there and then used a fx transfer company to get a much better exchange rate .
Sounds like you've had a nightmare but at least you've been paid out . Ive still got no idea why they do it as I can't work out what benefit they get .

Works out about 3000€ less in total, I know we where charged 1300€ each for checking that no other children have right to inheritance but the notaire hasn't told me this at all. It's a bit cheeky for her to send the funds to a foreign bank account directly, I kept my French account open so they could deposit the money there and then used a fx transfer company to get a much better exchange rate .

They sent the money to my french account in the end but at first they wouldn't send it all to me and had to send my brothers half direct to him, then they couldn't and I'd have to get it all via document signed by my brother to say it can all be sent to me. While we waited for said document funds arrived in my account and same with my brothers. Literally no communication at all.
It's not a case of we asked them to send it - they said they had to.
Waiting for a good time to transfer funds back to the uk now lol
Good point about the fees , I forgot yours was an inheritance so there would be extra fees , I've no idea if it's expensive or cheap but I remember the guy that bought my last house paid a 5 figure sum just for the pleasure of buying the house , just as well it was a private sale or he'd have had to pay the agents fees too!!!
Now all you need to worry about is exchange rate gambling, and it gets addictive watching the rates , I was really lucky to exchange at a good time , and as much as I'd like to say it was my financial genius it was just pure luck I got just about the best rate I've seen . It was a couple of years back now , good luck .

Coming back to this as well had a random letter to my mums old house passed on via several people.
Basically said solicitor never paid the bloody tax bill it seems before sending the funds to me and my brother. We have a collection agency after it now, I wrote to them to explain it with death certificates and a copy of the house sale form (not my copy as I've still never had any documents to say I sold the house!!)
All the addresses etc are wrong as we've all moved. My brother wants me to tell them to stick it and not pay it but i cant do it. I've asked for the charges to be removed and i can then pay the balance owed with what's happened.
Bloody notaire is a waste of space.
