Can Trafic wardens "Instruct" you to wear a Seatbelt and get off a phone if the vehicle is turned off ?
Also lads... can they "legally" touch your car ?

Cheers !

They are not allowed to touch or alter the vehicle in any way whatsoever. Hence bikers and even cars can have flip up number plates/covers and park anywhere without fear of getting a ticket...unless a policeman comes along, because then you are screwed

Sorry, not a legal answer, but logic wuld dictate no and yes respectively to those questions.

TWs have authority to enforce local parking restrictions. AFAIK their job does not include enforcement of any other motoring offences (it would seem a grave derogation of police powers if they could).

I suspect that if you have encountered one telling you to wear your seatbelt and get off the phone (although don't the police tell you to pull over and turn the engine off when making/receiving a call?), power may well have gone to the head.

Thanks for replies guys.
I was sitting in my car with engine turned off and without my seatbelt waiting for the misses when the warden turned up.
I ended my call quickly and smiled at the warden at which point he started tapping my window then banged the door as I ended the call. I took approx 15 seconds to end the call but when he touched my car I was not impressed ! and took his pic. From there it went downhill quickly !

If you were parked legally then he was probably some jumped up twit on a powertrip and he had no right to even bother you with his presence. If the handbrake was on and the engine off you commited no offence with respect to the seatbelt and phone (even if the engine was on and you had the handbrake off its still not in his remit )

If you were parked illegaly then he was also probably on a petty little powertrip but he would have had a reason to bother you. If he just tapped on the window to get your attention then he wasnt really interfearing with your car.

*edited to add* banging on the door wasnt right though and at the very least, grounds for a complaint.

Remember that assault can be verbal these days as well. Did you feel intimidated or otherwise threatened? If so, consider this an opportunity for repaying the karma...

I have just been told I am to be charged with a public order offense becuase the warden "stated" I swore at him (which I did not)
This Guy went bezerk when I took a picture of him as i asked him three times for his number which he then turned his shoulder and "nudged" me.

I cannot believe this .
My fiance and I were left for dead 4 years ago after been hit at 100mph. And we could not get a Policeman to turn up after making a 999 call !
Yet this happens becuase of a Traffic Warden claims I swore at him!
He left my 3 year old son crying becuase he banged on the door and Then became agressive even though he refused to issue a ticket !

Am I wrong in thinking the World is going mad !???

You say you are to be charged, were the police called? If so, things sound serious. Try posting on the SP&L forum, people there might have more of an idea of what to do. My advice would be to talk to a solicitor or the Citizens Advice Beureau and give them all the facts.

I have to attend the station with a vision to deciding on a Public Order charge under the offense for "apparantly" swearing !

Yet he bangs my car / and nudges me ! prior to any "dispute" actually happening.

Appointment made and off to station with My Solicitor!

What a total waste of time !

It is a mad world, but it's worse than that - it's sad and pathetic that this sort of bull goes on, there are far more important things, unfortunately I can only see it getting worse.

Time to start carrying a dictaphone round with you to "prove" what when on. Actually - did the person you were on the phone to overhear anything? Could be a nice witness.

How about you take your son to the station and then get him to point to "The man who made you cry"

Good luck!

Any sort of "barging" with a shoulder could just as easily be construed as assault! No stranger than the public order offence of swearing, I think.

If someone "barged" me with their shoulder I may have some choice language on the tip of my tongue!

IMHO

Have you got a few mates in the area to make complaints about his 'Bullyboy' tactics.

Did your wife witness any of this?

DID you actually swear at him???

you'll get a nice £120 fine for section 5 public order offence.

I got a ticket in London after the guy gave me permission to go and get change, then he swore at me and wasn't wearing his hat. He was aggressive and threatening and was lucky he didn't get a slap. I even had a witness, this builder guy who saw everything, and the guys number and still Westminster Parking did nothing.

I got the standard letter and told to pay up.

Cheers.

I'm sure I read somewhere that Traffic Wardens have similar 'powers' as the police... anyone care to shed some light on these people?

A 'proper' Traffic Warden is a junior police officer with less powers.

However those council ones are ticket issuers with a different agenda.

I'm kinda nostalgic for police traffic wardens - one let me off a ticket just because I was matter of fact with him rather than arsey.

Where do you live? It sounds like the local or even national media should somehow get to hear of it!

Just thought a bit more. Further to taking your child along, I would suggest that you are more than happy taking a poligraphy test.... In fact, be quite insistent. That should get the warden to back down if he's lying
