This came in my e-mail inbox from "Go-Audio". Seems like it's a bit of a 'WHOOPS' moment for Apple's Legal Department.......

Creative believes that the iPod breaches it’s "Zen" patent, which applies to the interface of its Creative Zen and Nomad Jukebox MP3 players. Creative applied for the patent in January 2001 and it was awarded on 9 August 2005. Their application preceded the introduction of Apple's iPod by about ten months. The interface was in use on it’s own portable MP3 players thirteen months before Apple rolled out the iPod.
Creative Chairman and CEO Sim Wong Hoo said "Before this invention, there was no intuitive and efficient way to deal with the large number of tracks that could be stored on a high-capacity player."
Creative are expected to try to claim a royalty for each iPod sold which uses it’s interface, but Apple are unlikely to take this lying down and the case will probably be long and drawn out."[/b]

yeah apparently some genius at apple didn't file a patent so microsoft, being microsoft, took full advantage and got the patent first. Apple may be good at coming up with ideas and even better at marketing them to a particular group, but they seem rather crap at the actual business stuff.
can't happen to a nicer bunch of people-we have been through three Ipods which have failed and now Apple are telling us to get lost.We are not alone as I have direct knowledge of three other people having similar problems. The lads IShuffle also failed and managed to trip up his computer. The G5 has a serious failure rate ( 31%-now reduced to only 16%)due to overheating.
mine broke and I was told a similar thing from Apple (admitadly I was outside of the warranty period by 3days). I know of plenty of iPods that suffer the same fate mine did regardless of age, model etc.
Having said that, I know of many iPods that are still working fine all these years on. Just depends on the luck of the draw I guess.

What? Thsi sounds like absolute garbage. It doesn't take a genius to work out that storing them by artist, genre, album etc is a pretty simple way of doing it. There must be considerably more to this methinks.

I'm on my 3rd mini iPod in just over a year. They may look nice and be easy to use but other than that they're utter $hite!However, they are also saying that as the 'novel' approach to the organisation & display was not particularly novel—as it was already being used elsewhere—that Apple should have no difficulty avoiding paying royalties.
It's just the stupid system granting patents to the first person who registers it, even though it's been used before.
For example, remeber that patent being granted on hyperlinks, however the company couldn't charge for their use as it was shown that they were around before they patented them.
BTW - I've ordered my dual 2ghz G5 the day they were announced and it's been repaired twice - once for a logic board failure, and the other for a processor failure. Not had any problems with my 1st gen 10gb iPod, 3rd gen 40gb iPod, iPod mini, or 23" cinema display.

If you bought it in the UK, ask the supplier to replace it - Sale of Goods act says stuff should last a reasonable length on time. The warranty is in addition to, and does not affect, your statutory rights.
