I've got a few friends who have moved into a new flat so far the car had been broken in twice and finally stolen and also the area is terrible they have caught people taking drugs outside the rear of the house.He was moved their from the old flat by their landlord, they are really worried about their safety now. Does anyone know if they can leave the contract early? they were moved from a nice flat into this dump and the landlord wont let them leave to move into a better flat.

but wouldn't they have signed the contract for the previous flat ?

why have they been moved ? Did they have the rent modified ?

something dont sound right !!

Wouldnt the contract be for the flat they originally leased? Dont think you can just transfer the contract over to another flat.

they were moved because he wanted to sell the old flat, the new one looked ok but its the area its so rough its beyond belief. I don't think its fair because they have found a much nicer flat in a better area (thats safe) and they cant leave

They still have to honour the lease whether they want to sell or not. They should not have been moved.

A lot of the time(least over here) if you are in a contract and the landlord wants to sell the unit, I believe the people in the contract get first right to buy the property or they can agree to terminate the contract.

i believe that they should probably be able to terminate teh contract without too much hassle if they are actually worried for their safety.

i guess it depends on how much hte landlord wants to preserve his image.

Seems like they may have shot themselves in the foot somewhat by agreeing to move in. Did they not check the place out beforehand?

When one party unilaterally alters the terms of a contract, after a period of time, the other party who might otherwise have had a right to treat the contract as frustrated can be seen to have acquiesced to the change in terms. However, for land, I would imagine things may be different, depending on what your mate's have done, what their contract says, and what they can prove.

Of course, as they're not likely to want to "get legal", their best bet might be to give the CAB a call and then have a chat with the landlord. Some sort of compromise may be 'encouraged'.

Okay, there are a lot of possibles here but I am assuming that they entered into an AST with the landlord on the original flat. If they did and they were 'holding over' in other words the original term had finished and they had not entered into a new AST and didn't do so when they moved to the new flat they can just serve 1 months notice (iirc but need to check) and quit.

If they entered into a new AST when they moved into the new property, which is what should have happened, they are stuck with it 'till the end of the agreed term.

Tell them to go to the CAB or a Solicitor with their copy of the agreement and go from there.
