Unless it was miss sold to them then I can't see why they should have that debt cancelled. It even says that it was a high risk interest rate and this is exactly the reason why it was so high, people don't pay it back. Banks are there to make money, not help people out with lifes little problems.

As was pointed out on Radio 2 the other day, when this loan was taken out base rate was 13 or 14% so the rate which applied to this loan does not seem so high in comparision.

Anyway why has i goot this far? What effort did they male to pay?

Certainly I believe even if the amount now outstanding is unreasonable they should pay something.

Who is paying the costs?

I did say it tongue in cheek Pat, I'm glad you noticed, but I still think the law has no teeth in these matters.

It would be interesting to see how much of the ORIGINAL 5750 pound loan this couple have paid off in the 15 years........

The law deserves no teeth in these matters and I am glad you lost 10k rip off is rip off if you defend it you deserve to be its victim.

What the hell are you on about ? Sign a contract and don't stick to it and you should be let off if you can't pay? It is a rip off but as long as they walked into it with their eyes open and weren't lied to or conned then surely they should be forced to honor that contract ? Not thinking should not mean they have no responsibilities or obligations.

You seriously think that the contract they entered into was a fair one? I think the judge was absolutely correct in what he did.

The world isn't black and white. What if you told a friend you'd drop a pint of milk around, and you didn't make it? What then, if that friend decided to sue you, because you entered into a verbal agreement to deliver some milk? What if he wanted £1 000, because he felt that was a reasonable sum of money for not being able to have a cup of tea that morning?

Whatever happened to common sense?

Have you read the Merchant of Venice? If not read it, the whole issue is covered there. I have spent most of my working life dealing with contracts. Mostly the intentions of those who write them are to deceive.
