Thought I might share my idiocy on here. Just taxed the midget for the first time since I got it 2 years ago, and was informed that it had been neither Taxed nor SORN for this time period - this is an offence. Oh.
Needless to say it was a series of assumptions that lead me to this. 1. that SORN transferred to the new keeper - it does not. 2. that I would receive a reminder every 12 months as per tax. - not in the case of a non-transferable SORN. Poo.
Expecting an unpleasant letter from the DVLA now.
Hope someone can benefit from my idiocy.

Hi there, was it on a sorn when you bought it?
If it was not and it has been untaxed prior to the sorn legislation(1999 I believe) then there is no requirement to have a sorn and your vehicle can remain untaxed and un-sorned with no penalty.
If it was on a sorn or had been taxed after the sorn legislation (1999) then you are unfortunatly liable for a fine from the DVLA.

I'm sure I read an article or thread somewhere recently that it had been proved in court that (and it was something like this) the DVLA had no legal right to fine you for not taxing or informing about the vehicle - wish i could remember where i saw it? maybe someone with a better memory will be along soon to either post a link or shoot me down :-)

I think I remember reading about this recently too.Mr E Driver said:
As you have to declare on the SORN where the vehicle is being kept, having bought it and changing where it is kept I would have thought it is obvious that the SORN needs renewing?
If Stedale bought the car and the previous owner said that it was on SORN I can understand the assumption it would just continue ... and if Stedale's never filled in a SORN before (I haven't) how would he know what is on the SORN form ?Have a read through of this...

I do hope you can wriggle out of being fined, without having to drag the case through the courts. Good luck anyway.

I think you will be ok , i had a similar situation but did not realise that declaring Sorn was mandatory. Apart from the usual letter advising me that my tax was due and as the car was off the road i assumed all was well until mentioning this to others who pointed out that I was in breach . I wrote to my local DVLA centre who said it was nothing to do with them and heard nothing more , I then went ahead and taxed it on line and have heard nothing further.

News to me too. But as regards the problems some people seem to have with SORN and fines, I've always found that doing it on line is far better than snail mail. You get an instant response from the DVLA (which I print off and file just in case) and the chance - deep breath - to win a Seat ibiza!
