Points, bans, fines. Few Questions
Discussion
I have a few questions, which some people may be able to help me with. I doubt everyone will want to discuss on an open forum, so pm's would be great
I got banned awhile back for excessive speed. Some know the story and some don't. I fought it for a year and basically lost.
Nobody had told me that when i did finally get my licence back it would only have one point left on it and i have a zero alchol condition too. Anyone else had this double shaft up the rear end? I thought a ban and 6 demerits were enough of a punishment for driving 90mph in the countryside at 10pm at night. Aparently not!
With only one point left and the ferocious police in SA i can not see me lasting the full year before i get my 6 points back from the original ban offense.
Are all states the same? I am in SA.
Cheers and happy motoring, haha....

My son lost his Qld licence for non payment of a NSW fine, that he never received.
The judge was not interested at all that the navy had lost the mail.
When he got it back it was with full points, but was a P plate licence.
Fortunately although P platers are not allowed to drive V8s, or turbos, he was allowed to drive the V8 because he already owned it.
You would be silly to look for justice in any of our courts today.

Does not sound right to me...I always thought that when you have finished the ban your debt to society is served and you start with a new license? I know that if there is more than one punishment they are served one after another and not together.
Well after chatting to the police and solicitor in SA getting a licence back with 1 demerit point left is the norm.If that point is lost then you get banned for a further 6 months, then have a license with one point and conditions again, for a year. The demerits that got you banned do not get added to your demerit tally, they are wiped out with the ban.
Every 5 years you have the right of appeal, which gives you your licence back with the conditions above for 18 months. Blow that point and you have no appeal, and would be banned for double the length of the previous ban then a year of good ole' one point fun.
Hope this helps others out who did not know this information like me.
I am not sure if this is only for SA or all states, so don't shoot me if i am wrong for where you live

In WA you can get 12 demrit points before you lose your licence for 3 months
But say if you have 1 point left and get a 3 point offence when you get you licence back you will have 10 points
Also they do a double or nothing system here, Where if you lose your licence for 3 months you can still drive but if you lose anther point in this time you will get a 6 month ban

I think that system changed...don't you now get 1 point to last 12 months and if you lose it you get a 12 month ban? I think Tim did this but it's only available if you 'tot up' your points and not with a serious offense.
I reached 12 points and was offered either a 3 month loss of liscence or a "good driving behavior" option, drive around for 12 months and if I lost 2 or more points in those 12 months, then Id have lost it for 6 months. this 12 months finished for me last June. funny thing was, I lost the allowable 1 point 3 weeks before the end, boy was that last 3 weeks nerve racking. So yeah, you about right. (Im in Qld though)

What happens after you get your licence back though? Do you have conditions? On mine after a ban i have 6 demerits after a 6 month ban, with a conditional licence with only one point left for 12 months. So in SA if you totted up the points and got banned, you would still have to drive on a conditional licence for a year with only one point to lose. But say if you have 1 point left and get a 3 point offence when you get you licence back you will have 10 points

It seems a very harsh system here. I thought the 12 demerit and 3 month ban system was leaniant, but with the extra conditions it is far from it! As the police seem so keen to earn revenue here i commend anyone who doesn't get a single demerit in a year!
Got home to the dreaded OHMS letter.
Opened to the top of a letter with only the words 'TRAFFIC INFRINGEMENT NOTICE'
Then realised, yes that is my car in the photos. st.
Now given that recently I've driven as if releasing all 360bhp as often as possible is a challenge to be met head on my ahole started trembling like a Japanese nuclear power station.
Tonight I've learnt that if you do 68kmh in a 60 limit you only get a $75 fine and 0 points
