hi,

2 years ago, When i was in Australia i got a speeding ticket from the police but i left the country without paying.
Until now, i didn't receive any letter from Australia to ask me to pay the fine.
I rented the car so it wasn't mine.

Now i totally regret.
But i wanted to know if it's possible to get an Australian police record because of that??

In fact, i'm actually living in France and i applied for the residence in Canada.
So i have to get a a certified criminal record check in Australia because i lived in this country more than six months...

So i'm afraid to have an Australian police record for that...

I'd be surprised if it was classed as a criminal offence that you would have a record for, but I do know they view these things negatively and you can end up with all kinds of issues getting back into the country especially visa-related issues.

But do I know? No.

Send off for a police record check anyway? Unless it has to go directly to the immigration people in Canada you will then be able to read what it says.

If it shows the outstanding traffic infringement you can then organise to clear it.

Also double check your credit card statements. Assuming you used a reputable hire firm you would have used a credit card to hire the car, when they received the fine they would have tried to contact you and then just charged your credit card for the fine.

You'll potentially have an outstanding unenforced warrant for your arrest that will most likely show up on a police check.

The easiest way to sort it out would be to phone up the state autority where you got the speeding ticket and just pay the fine if they have anything listed against you before you apply for the police check.

Not worth getting turned down for a residency app just because of a couple of hundred bucks for an outstanding speeding ticket...

To help a little.

I live(d) in Western Australia for 12 years. If a fine goes unpaid, be it a fine from a court, speeding fine or parking fine it will eventually lead to the suspension of your driving license.

Best to contact the Australian consulate to enquire about any fines and get them paid IMHO.

I doubt very much that you are on trouble. I missed a court appearance as I left the country prior to paying a fine in a rental car - no problem at all.
You can phone the police and check what fines / points are outstanding , a quick net search should reveal the number.

The rental car company will pass on your details to police, they will not pay the fine or charge it to your card. The fine will then be issued and non-payment within a certain amount of time will then mean it's passed over to the Magistrates Court for further enforcement, which can mean various things including warrants for your arrest, license suspension etc - you really just need to contact them to sort it out and usually just pay it immediately.

But it was 2 years ago and i've never received any letter from the Australian police in France so...

When my parents were last here they picked up a speeding fine in a rental. The fine went to the company who then called me (I was listed as the contact phone number). They charged my parents credit card and posted them a copy of the fine and the payment receipt.

Maybe it is different in WA?

You are best to pay it. You are not always notified in all jurisdictions. For example..if you get three speeding tickets in NY State in 18 months its an automatic suspension (even if yo have paid all your tickets) and they do NOT notify you. Next time you're stopped its a felony.Also they border patrol can access your record to see if there are any fines.

Sorry I can't help but i got a ticket for speeding in Sydney and decided it was best to pay the fine as we would probably be applying for PR and din't want anything against us. i got a letter saying we have 3 points as a result but as we have a UK licence only I'm not sure where they're going to put the 3 points? Maybe if I applied for an Aus licence in the future?

They will apply the points to your Australian license if and when you get it.

Of course, if it is 3 years since the "offence" then those points shouldn't appear.

No. A speeding ticket is not counted as a police record.

In a hire car they will either say they don't know who was driving, or they will charge your credit card. It will not get sent to you, as you are not the registered vehicle owner.

100% correct, traffic offences do no count on your criminal record, unless its dangerous driving or something worse. And police hardly if ever chase these sorts of things up

It’s a $450.00 and fine no points, it’s not a criminal offence, unless you were doing over 30k over the speed limit.

But if your fine goes unpaid, it might be escalated to criminal.

Not paying the government is serious.

An update on my situation. I did get citizenship and got an Aus licence. The points never appeared. Furthermore I moved from NSW to Qld and had 9 points on the NSW licence but got a completely clean Qld licence.
I’m currently on a good behaviour licence agreement for 12 months after getting done by a new camera on my daily commute for 5 days in a row!
After 20 years of UK driving I only got one speeding ticket and that was when I was 17, in the last 10 years here I’ve been done maybe 20 times and I drive like a granny!

I think you'll find points now carry from state to state, I got booked for 73 in a 60 zone in QLD in 2013 and the points appeared on my NSW licence, my mate who was behind my got booked for 72 at the same time, his was half my fine and 1 point instead of my 2
