My car was one of the cars lost in the fire at TVR Power, while it was booked in for a 1000 mile service after spending £7500 on engine rebuild/clutch and service; my insurance company has paid me a sum based upon its market value, less the excess.

However today I receive a letter stating

“In order to pursue a recovery we have to prove beyond doubt that the other party was negligent and based on the information available to us we do not believe we have sufficient evidence to support a claim of negligence against the other party”

So my insurance company will not pay my excess which is a considerable amount.

Why should I lose my excess, this seems wrong?

What's the best way to get the insurance company to pay the excess?

Check to see if your policy has 3rd party excess cover.

If your company is not willing to pay, the 3rd party may do so. Most policy's are one of indemnity which means you "must be placed in the exact position your were before the loss".

Your insurance company should be able to subrogate against the 3rd party insurer and I'm sure you are being stitched up.

Personally I wouldn't have claimed on my insurance, surely your car was in the care of the garage and therefore covered by their insurance?

As Jools said, I would have thought your loss would be covered by the business insurance rather than your personal insurance.

IIRC, there were other cars damaged too, it may be worth you asking what they did?

If you have decided to go through your own insurance (no way I would have) then I suspect it will be too late to change direction now.

Work out what you are short, excess etc and ask the garage to cough up, they have got away lightly. There is no way as a customer you should be out of pocket as a result of anything that has happened whilst the car was in the care of the garage.

Too late now he has already claimed on his own policy and been paid, less the excess.

Surely he could now claim the excess off TVR Power's insurance?

Thanks guys, having never in my life claimed on any insurance policy car or otherwise, I thought all my dealings should go via my insurance company, i.e. they pay me(which took nearly 5 months to get) and then they claim off the other guys insurance (in this case if that is TVR Powers insurance or the guy who’s car started the fire I’m not sure)

Will talk with my insurance company today. Thanks for the replies

I'd mention re-cooping the money through TVR Power, you don't want a big claim effecting your premiums when due.

Yep, as already mentioned. Work out what you are out of pocket following this fire, after being paid out by your insurance company then write a nice letter to TVR power requesting reimbursement.

Should be no trouble getting your full excess back.

Should your claim have been included in the TVR Power assesment when when there claim was prossesed,

The insurance policy had protected no claims, so my no claims bonus is not an issue, although the policy will be left to expire as it can not be cancelled, because of the claim.

It would seem you may have been poorly advised by your insurance company. If your excess is claimed back by your insurers you will get it back. If the claim is with your own insurance company please be aware that although you have "protected " no claims and indeed, you will remain on the same % discount the insurers always increase the premium due to the claim. The garage will have insurance to cover and your vehicle replacement and all associated costs should be covered. Take legal advice before writting to anyone to ensure correct wording and therefore letting everyone know you are serious.

I'd be surprised if your insurance company is no pursuing the building/business insurers for payment.

When ever I have made a claim my insurers have paid me less my excess and I have then this excess has been paid out by the other party's insurers.
It might be worth talking to one of the specialist claims organisations. One or 2 have been recommended on here.

Seems that there are some true honest gentlemen left in the world today, Dom from TVR power has just phoned me and will write me a personal cheque for my excess.

Good stuff TVR Power.

Actions like that make me put the extra effort into to travelling up to Birmingham to use you for my next service.
