Legal Advice regarding accident
Discussion
Looking for some advice from you guys aswell please.
I had an accident as some of you are aware back in may time and THIS thread will explain most of it all.
now i had a call in January which THIS thread covers
Lots of reading but for those who are still interested at this point ive now received a letter from one of my solicitors another department stating the below.
"Of most significance is the versions of the accident given by yourself and Ms XXXXXX as to how the incident occurred.
It does appear that Mrs XXXXXX was atleast in the wrong lane for the Direction she was travelling although some critism may attach to you on the basis that you should of been aware that a vehicle that was traveling in the nearside lane may not actually take the exit it was heading towards.
For this reason it appears that it is unlikely that if this matter does go to a liability trial then liability will be split in some form between yourself and Ms XXXXXX although I will leave Cogent" (the new solicitor) "to discuss this with you in due course."
Can anyone offer me some ideas? as I believe that I did nothing wrong and had no chance of avoiding her due to her timing meant I was basically next to her and had no chance of avoiding any contact.
Also would I be able to change solicitors if I wanted to at this point as nothing has come of the court hearing so far but I'm loosing all confidence in the solicitors and would like someone who is experienced and I can actually setup a meeting with to discuss in person as I'm beginning to loose my rag with it all.
so any recommendations' would be welcome.

It does appear that Mrs XXXXXX was at least in the wrong lane for the Direction she was travelling
off you got to court, even her insurers are admitting liability.
the rest of the guff they have written is to try to warn you off taking it to court as they know they will lose.
get confident, its a no brainer.

I think I may be emailing him tomorrow explaining my situation as i gather they are pretty good.
You've got nothing to lose. If you don't ask, you don't get. Worst he can tell you is that you're buggered. So go for it.And whilst I've had any dealings with him outside of PH - I can only say that everyone who has had dealings with him have had nothing but utmost praise for him
Rich - you probably don't want to hear this, but I had a similar incident a couple of years ago... On a main roundabout on a Sunday morning that had peak time traffic lights that were clearly signed as such and obviously switched off being a Sunday.
To cut a long story short a 70 year old Polish man swerved across in front of me and slammed his brakes on when he saw the blank traffic lights at the last minute... Despite witnesses saying it was absolutely his fault, him admitting it at the road-side and he didn't technically have insurance as he was driving on a British insurance policy with a Polish driving licence (he told the insurers he had a British licence); it ended up going 50/50 following a hearing... He also refused to give details at the roadside claiming he couldn't write or read English. Yet he managed to write his statement for the insurance 2 days later and completely contradicted my statement, the photographs and the witnesses!
So, insurance is a finicky thing and in my view take it all the way but be prepared for a non-sensible result and that way if you win it'll be a huge bonus!
