been made redundant last thursday and was told face to face and that i would receive a letter confirming it. now ive not received a letter and really could do with leaving asap to get uni work done as i dont have time to sort out uni work, look for new job and sort out some other problems im having atm.

now im on a months notice and been here 8months so dont really qualify for a payout. i was told i could leave whenever i needed to and have as much time as needed for interviews etc.

now if i leave in the next week do they legally have to pay me my full notice bearing in mind theyre fairly simpathetic to my uni work.

thanks

Rich, not 100% sure of the legal dos and don't but as far as we are aware, if you are monthly paid, they have to give you a months notice and pay you for that month. In all honesty you are better leaving as soon as possible. You might as well have the time off to concentrate on uni, interviews etc whilst being paid rather than wasting the time being at work if your going to get paid anyway!!

HTH

PS why didn't you say anything on Thursday evening? We would have got you royally p155ed!! hehe

Recently went through the same, I would urge you to have a word with the citizens advice - they will have people who can help and are qualified to give advice.

I acted as an employee rep when I went through it so had access to a number of guidance documents relating to how an organisation must treat its employees while going through the process. It is very difficult for an employer to make an employee redundant within the law without going through quite a long process, should be given notice of a companies intention to make you redundant before being given your notice of redundancy - sounds like they have missed that step for you guys!

There are a number of other considerations that have to be made relating to previous redundancy packages (setting prescient), alternative roles within the organisation etc - depending on whether you just want out or not I would give CA a call............

Still have some of the notes etc somewhere, will happily mail them over if I can find them.........

If in doubt talk to ACAS

I took my last employer for the thick end of £21K in compensation for fkin up my redundancy.

Depending on how many they are making redundant as to how long your period of consultation should be.

The period of consultation starts when you emplyer formally advises you that you job MAY be at risk.

They also need to show good reason why you were chosen as opposed to anyone else.

email me if I can helpthumbup
