Be aware that driving with your foglights on (in conditions of not reduced visibity) will;
a, Attract the attention of the police.
b, annoy drivers coming in the opposite direction, (especially when the road is wet and even more especially at night)
c, be against the Law,
d, possibly indicate that you are not an experienced driver,
e, make a less than complimentary statement about yourself,
f, NOT LOOK COOL.

But when is a fog light not a driving light? I'm sure the elise I had and the VX I now have labeled what we would call fog lights as 'driving lights' So would that avoid me getting a fine?*

  • in principal, as I'm just not cool enough to be able to get away with driving with fog lights on unless it's foggy.

This was a forum topic on speed plod and the law. It was suggested that driving with fog lights on in less than 100M visability in accordance to the road traffic act would be "Driving without Due Care and attention" CD10 up to six points and up to £1000 fine.
It was described as "Driving with light not suitable to the conditions" that only had three points and up to £100 fine. Still could fall under "Section 59" so only use you fog lights when it's foggy or you car will towed and crushed.

Foglights used to be defined in the old Construction and Use regs (vital reading if you are customising readit) as lights fitted with their centres less than 24 inches from the road surface and having a warning light in the driver's cabin to show that they are on. Or words to that effect.
The description of Driving Lights is more or less;
Driving lights are lights that are only on with main beam and are extinguished when dipped beam is selected. They may be fitted at less than 24 inches from the road surface.They may be controlled by a awitch in the driver's cabin but must only be on when Main Beam is selected. IIRC.

In practice, Foglights are fitted low down for 2 reasons;
1, They are near the road surface and so may project further (as the air is sometimes warmer than the dew point and so is fog free) and so illuminate an object further ahead. They also used to have a wide beam and so illuminate the edges of the road.
2, The reduction of the Tyndall Effect. (This is what causes modern reflective surfaces to throw light back in the direction it came from and is also caused by the spheres of water that form Fog.)

So;
If you're on Dipped beam and are showing "Driving Lights" you will be breaking the law.
It's simple.

The fine has already, recently, gone up to £60. Still a non endorsable offence (no points), though.

They should just sell cars with the fog light lamp on the dash on all the time, but dont fit the bulbs in the actual fog lights,

How cunning is that eh?

Indeed, and all down to the Swedish lights on all the time rule. I remember my first car having space for a relay to do just that for the Swedish market.
