Discussion
Hi,
I have recently been caught at 51 in a 40 zone, after visiting PEPIPOO the NIP wizard suggested returning the NIP unsigned and ignoring any further correspondence as I live in Scotland. However, it appears that the last time this has been used was in 2004.
Is this still a valid route to take or has there been some progression with regards to the law in this area? I do not want to roll over and take the points but nor do I want three points and a larger fine for failure to provide information. What to do?
Any help much appreciated.
Regards,
Ben

How about not doing 51 in a 40 zone ?
I think the Horse has bolted on that one

Old news Im afraid.
Put simply, the loophole that was the non-signing of the NIP has been closed and you will be taken to court for failing to provide information if you do not.
Take the rap like everyone else.
Where were you caught incidently?
Caught up in sunny Aberdeen....
And no, its not a 'fair cop'; yes I was (probably) speeding but I do not find the law a fair one, the scamera van was parked just over the crest of a hill on a straight road with no traffic in good conditions. So what, prey tell, is fair about that? I believe that I was driving appropriately for the conditions. I take it you've never breached any limit?....
Edited to say that I have put this thread in the Scotland section and the 'Speed, plod and the law' section and have recieved conflicting replies. Either way, looks like I may have to bend over.....

If you want to try to get aff with it I guy I worked with stated in the return section of the NIP that he did not know who was driving, it was a car which is used by, or at least could have been used by several people. His live in girlfriend was also caught recently in his car and he did the same again.
He requested the photo, and then said he still could not recognise who was driving, there were a number of letters passed back and forth between him and the police/procurator and eventually the police gave up in both cases.

As stated above Ben, I have broken the limit, I have also been caught, I don't like many limits but until they are changed if i break them then it is my fault - personal responsibility and all that !
Agreed. Feel sorry for you and all that but you know the rules. I got caught doing 72 in a 50 that had been changed since the last time I had driven the road. The coppers even said bad luck - my view was I should have been watching the road signs - my fault.

Didn't know the mobile camera vans worked at night
Was it a forward facing one or did they take a rear photo?
Would think the standard vans that take you head on would not come out due to the intensity of the headlights?
It was one that takes your picture head on, think its a laser but don't actually know. But it was dark, never even saw the bloody thing. Sneaky buggers

No it hasn't and no you won't necessarily.
www.pepipoo.co.uk if you want to dispute it. You'll find plenty of more recent examples there than 2004.
If you know you were driving, know you were doing that speed and so on, then fair enough, take the penalty. If the only indication you've got that you were doing that speed is the NIP itself with no accompanying photo and you don't think you did exceed the limits by that amount, then contest it.
