Hi all. Just received a 'Parking Charge Notice' from Total Parking Solutions.

What's the deal with these, is it still un-enforceable or should it be filed in the bin?

SWMBO is getting it in the ear though, she was asked if it was alright to park there, relying on her local knowledge, and apparently said 'yes, I park here all the time when out for dinner!'. I'm gonna get mileage out of this! biggrin

Don't think it's enforceable, before someone says the woman in Dundee was made bankrupt when she was taken to court for owing around 20k, she continuously parked for yonks without a permit, and continuous got a parking notice.

Can't see they chasing you for a one off.

Where was it?

My ex parked in Livingston centre for about half a day and got a ticket. We ignored every letter which became more threatening each time. They threatened court action etc. My defence would’ve been not receiving any letter as none were sent recorded delivery and the car wasn’t ticketed at the time as it’s all automatic.

If you have a google for Total Parking Solutions, all the sites I found advise to ignore them.

They are enforceable but can't be enforced in Scotland unless the driver is known. The usual advice for Scotland is ignore them and never admit being the driver.

Is there not something about them having to prove income was lost by you using the space for longer than allowed?
I assume all the retail outlets they look after the car park for would have been closed at the point you exceeded your allotted time?

So they have number plate recognition on that stty little car park?

The Supreme Court ruled £85 was reasonable during the Barry Beavis v Parking eye case so that changed all that.

Some say the supreme ruling doesn't apply to Scotland and some say it does. Until a case goes to court using actual loss as a defence we wont know.

impossible to enforce in scotland under current laws...

just ignore.

They have to ticket the driver that committed the offence, they dont know who was driving and there is no legal obligation to tell them in scotland so it cant be persued.

also it is not a parking fine. just bin it along with the threatening letters
