Imagine the scenario.........

The other half is wanting a new car. For whatever reasons she decides upon a Mini Cooper Convertible. After a trip down to Lister Park, Bradford, we find out that there's a waiting list until January 2006. Deposit put down.

Last week we get a phone call saying a Mini Cooper S Convertible in the exact spec we want is available for late November delivery, so we snap there hands off.

Yesterday, we get a phone call saying the wheels we want are 'unavailable' ? and that we will have to have alternatives. A tad pi$$ed off we agree to them. Today we get a phone call saying that OUR car has been sold to another customer ?

Now this is where is getting funny ........

The dealer told the other half the car had been sold to a person in Stockport (our deposit has been down nearly 2 weels), however, we could get another car the 1st week in December the identical spec, BUT, they need a decision within the next 15 minutes.
The other half phone me, so I phone the dealer. He tells me that OUR car has been sold to someone in Sunderland (not Stockport) & that an exact specced model can be our the 3rd (not 1st) week in December.

I say, as any normal person would, "what are you going to give us for the inconvenience", only to be told in no uncertain terms "f@ck all", and added "do you want the car or not".

NOW, if it was me, I'd have told him to f@ck off instantly, but knowing how much she wants the car I told him we'd get back to him by 5.30pm.

At 5.15pm I get a call from the guy asking whether or not we'd decicded as he has "other parties interested", and that "he could not hold the car".

I proceeded to ask him how he was going to make up for the fact that the other halfs car was now sold, and that as a result of HIS nob-headidness I was going to have to hire a car for 3 weeks, should I take his new offer, to which he turned into a right pr!ck, actually ending in him hanging up on me after offering me DISCOUNT rental of a 205 ? until the new car came.

Now, I may be wrong here, but I just bought a 21K mini, I was guaranteed delivery next Saturday, and yet they don't give a f@ck.

What would YOU do ? Personally, if it wasn't for the fact that she wants one soooo much I would have told him where to stick it instantly.

How do dealers/people in general get away with this ?

Needless to say, other many a pint in the pub I've told our lass to tell them to f@ck off (but only to there face, tomorrow, in the dealers), and to go get a Boxster (I know, not much better) which she REALLY wants.

I know Mini won't care as their cars walk out of the showroom, but surely they can't keep treating people like this, can they ?

Disgusting attitude, they don't deserve your money.
If they are like this before you hand over the cash, what are they going to be like afterwards? Have you tried Scotthall in Leeds?

On reflection, know of PH's 'naming & shaming rules', I hereby give me the contact details of the said salesperson who can give his own version of events:

No naming and shaming please..... This includes givin out Tel. and email of dealers ....

If they took a deposit off of you to secure a car for a particular delivery date then surely its breach of contract? I'm no legal head but I think you should be able to claim for proveable financial losses as a result of their breach of contract?

If it were me I'd write them a letter stating you'll take them to the Small Claims Service to recover the cost of hiring a suitable replacement vehicle, taking the time off of work to do this and I'd also seek return of my deposit and interest earned.

Quite simple.

Write to the dealer principal expressing your disgust and concerns ,send by RECORDED delivery, threatening to write directly to BMW, if you don't get satisfaction.

On principal I would have the depost back immediately and go elsewhere.

Dealer obviously likes being a to55er and thinks he has something you want. Get your deposit off him, loudly on a Sat AM when other punters are browsing. Tell him loudly which other Mini dealers you're going to see next.

Why do you HAVE to get a new one? Why not get one 6 months old. I drove past Sytner in Wycombe today and there were 2 on the forecourt. OK, they might only have been Coopers and Not S'es, but come on - it's not a sports car anyway.

I must admit that I thought once money had changed hands, you had a legally binding contract. Why not have a little chat with Trading Standards?

Nope, just like not all estate agents are, nor are all policemen or all solicitors.

In our industry you will find good and bad, just like every other walk of life. Some will be good, some won't.

I'm sorry you have had a bad experience with the dealer in question but please don't group us all together.

Good point - and reminded me that a good mate of mine has his up for sale at the moment because he's moving to France. Not sure of the details, but I know he hasn't had it 5 minutes, and it has a full set of toys. Drop me a mail if you want me to ask him.

I had a similar experience a few years ago with a Jeep I was buying for my wife. "Our car" fell off the boat or somesuch and it was the only green one in the country so would we take a blue one? Yes we would but........... Dog gate, CD player and an extra £300 off later and the wife had a blue Jeep.

As far as legal redress is concerned, you've got no chance whatsoever unless you specifically marked the order form with "time is the essence of this contract" and even then you can show no loss as they offered the money back. Trading standards would not want to know.

I agree, i just wouldnt give them the satisfaction of treating you like sh-it even if i had to sit there and burn 1k of my deposit in cash on his desk in front of him.

Its the whole ethos i dont tolerate-- that whole..ive got somthing you so want so i can do what i like and youve got to lump it.

Take your deposit back, on a saturday... write a letter showing proof of deposit taken`ness...and with records of what has transpired. (probably a bin letter but you never quite know)

Go elsewhere and take your self respect with you...intact!

Agreed. But also get a few hundred copies of your tale printed and then spend a couple of Saturday mornings giving a copy to anyone who enters the building. Don't go on their property. Don't get into any sort of argument. Just keep to the public footpath.

They WILL resolve it to your compelte satisfaction. Trust me.

Got a phone call from the pr!ck, sorry, from Martin, first thing this morning saying, by magic, the car was avilable again & did we will want it.

I think you can guess my reply.

When I asked about the monies being credited back onto my car he had the gall to say that "deposits are non-refundable". Oh, how I laughed, the stupid tw@t.

2 Minutes later, another call from the sales manager (woohoo, not), asking again "do I want the original car ?", to which the same answer came. He then went into a crappy story of what had happened, and that "if it seemed to you like we were not bother, I can strongly confirm this is not the case".

Whatever. Where's my money.

"will be back on by the end of the day" said he.

Thankyou, not, and goodbye.

Result. Still write to the Dealer Principal and STILL consider the leaflet drop just to push their nose in it. How many people would allow themselves to be bullied by such tactics?

Disgraceful - They deserve to go out of business.

BMW stealers :coffeebeans: - seem to get off on it, but I have faith that what comes around, goes around. Already talked my MD out of an X into a Lexus RX, IT manager from a 3 series into a Honda Accord etc.. I have a mission, but obviously don't need that much help.

And now let us know about the Porsche dealer with the Boxster 'acquisition'

Maybe so, but they were extremely nice (well, for Porsche dealers). They did however mock the TVR slightly

Anyway, deposit paid. The other half now has one of these getting delivered on the 17th December:



Boxster S, silver, black leather, sports chrono, 19" carrera wheels, parking sensors (one for the ladies), multiplayer CD, BOSE system, painted rollover bars, wind deflector, etc, etc.

Just in time for winter

Aye my friend just bought one of those from Leeds Porsche erm and another a Fez 360, and i can say everyone was pretty nice and helpful, They dont even try and sell you anything, they are quite happy just to have a chat--obviously enthusiasts of the marques.

cue== somone elses bad story of horror..lol

I might just go and take my trev down and rattle the windows if they are mocking!
