If there are no speed limit signs lit up then the National speed limit applies on the Smart motorway.The question I have is, are the cameras still armed if nothing is displayed on the gantries to show an enforceable speed limit i.e. 50 mph.
Could someone potentially go through at 90 and not receive a penalty ?

In Yorkshire on the m62 , when the variable speed limit is off (national limit) I have gone past cameras doing 80mph and I have never had a nip. So I’m guessing when the m60 is fully operational it would be the same.

I finally got a response regarding the M60 :

“Thankyou for your recent email to the Highways England customer contact centre in respect of smart motorway speed cameras.
I would firstly point out that whilst Highways England install and maintain the cameras, we have no input into enforcement of speed limits as this is a matter solely for the local police. I can therefore only give a limited answer to your queries.

In answer to your questions:

Q1. I assume that when the unrestricted sign / National speed limit sign is displayed then a speed camera will be armed and would detect a car travelling at 90mph for example...?

The current generation of speed cameras in use on smart motorways are digital and capable of enforcing all speed limits including the national speed limit and could detect any vehicle travelling above the speed limit and any threshold applied.

Q2. My second question for definitive clarification is, if there are no speed signs displayed on the gantries are the cameras armed ? Although 70 mph is enforceable if a car travelled at 80 - 90mph will it be detected and flashed by a camera in these circumstances ?

If no speed signs are displayed, the cameras can enforce the national speed limit. Thresholds at which enforcement begin are applied at local level by the respective police forces.

It's not really an answer though. 'They are capable of' doesn't confirm if they are actually enabling this function or not.

Anyway it's all academic as they seem to be set permanently to 50mph despite no work going on.

What did you expect the answer to be? They’re hardly going to say “We don’t bother enforcing speed limits when NSL applies, feel free to go as fast as you’d like”

As other posters have said, I’ve driven along the M62 between Brighouse and Leeds and the M25 from the M40 to the M23 a lot and whenever there’s no speed restriction, I do c85-90 and never had a ticket.

The M60 I currently sit at 57 on my speedo as the roadworks limited 50 is still there on my stretch. I’ll apply the logic in paragraph 2 when / if the bloody thing ever reopens properly

I expected facts, which if I wanted to persue with GMP I am sure they would supply them.
There is a duty of clear and concise information and the avoidance of stealth.
I wrote to the HA about the M42 SMART motorway and got the definition, several years ago.

The recent response is not helpful from the HA, I agree.
