Hi Guys,

I am hoping that one of you might be able to point me in the right direction.

In the past 8 months my CSA payments have gone up from £140 per month to over £500 per month by the time this new asessment comes into effect.

As you can imagine i am very miffed at this and see a few options open to me.

The first is fake death and hide as a bhuddest monk in tibet and see out the rest of my days making novelty souveneirs out of Llama hair.

Shoot everyone who works for the CSA.

hand over all of my pay to the blood sucking ex wife and ask if i can have some pocket money if she has anything left.

Seriously does anyone know of a good solicitor in this area that is up on CSA cases.

I totally agree that i should pay maintenance and am not trying to shirk my responsibilities but this is quite a big increase especially when we have a baby on the way (good news is the CSA will allow us £10 per week when the baby is here).

Sorry for any sarcasm and the poor jokes but if i didnt try to make light heart of it i would probably crak up!!!

Cheers

Andy

Can I ask how many children did you have with your ex wife and what are their ages?

The £30-£35 a week you were paying seems very low.

Personally if in that situation I would want to ensure my kid / kids were looked after as opposed to living in poverty.

as a general guide line under the current rules for 1 child you will pay 15% of your earnings 20% for 2 children and 25% for 3 or more however if you have back payments they may be added on
so if you earn 2k a month that would be about right
ps i dont work for them

I am paying for one child who is 12 years old.

I dont mind paying for him at all...the thing i am wound up about is she is married again and they are not taking into account how much her husband earns but they are taking into account how much clare earns.....???

I take home 1300 so the 15% for one child.....hmmmmmmmmmm seems a bit out to me...!!!

Dont mean to be rude or offensive...like i say i dont mind paying the csa...but i would be better of taking redundancy as my mortgage is covered and getting a part time job like working behind a bar rather than the job i have trained for for a long time

Quite right as well....which is when we split i left her with the house and contents...she sold the house a year later and made 90k!!!
She is in full time employment(lloyds bank Stocks and shares)...so is her husband (Self employed plumber) and now they are getting £500 per month...bearing in mind i am expected to pay for HALF his up bringing costs so that means a 12 year old costs 1k per month...the poverty you refer to...i know people who work full time and that is nearly a months wage to them...or not very far off that and support a family on that.(both parents working)

Oh by the way when i first started paying CSA payments they were £400 per month 9 year ago when i was earning £800 per month...it then dropped to £140....when i next saw my ex wife she said to me "Thats great, how am i meant to pay for the pine furniture i have ordered for the new conservatory...?"
Poor woman living in such poverty!!!

idea Oh I seeeeeeee.... the CSA are taking YOUR partner's earning into consideration...!

I thought you mean the ex... oh bu99er

Years ago I was blind-dated with a mate of a mate called Claire: unfortunately I got p155ed and heaved all over her bathroom, so didn't get a shag
Then I got it into my head that I had to 'have' a Claire, and bu99er me the next date I got was with another Claire!
Ten years later we split up; she bought my share of our house for £5K and 18 months later sold it for £45K profit banghead

Wimmin. Can't live with 'em, can't leave 'em at the side of the road either... hehe

I believe the 15% or 20% of net pay is then reduced by 1/7th for each night per week the child stays with you - averaged across the year

So eg for one child, 15% of £1300 net = £195

If child stays between 52-103 nights per year with you - this is reduced by 1/7 = £167
If child stays between 104-155 nights per year with you - this is reduced by 2/7 = £139
etc

Your partners earnings are not normally taken into account, nor are your ex's (or her parners). There may be some variation to this in extreme cases

ps. plus as you say above it is also reduced if you have other child(ren) - called "Relevant Other Children". They do this by reducing your net income by another %-age before doing the above calc

So if you have one new baby, £1300 becomes £1105 (reduced by 15% for one relevant other child), then this feeds into the calcs as per my previous post

So for one child - £1105 x 15% = £166 , then reduced for any nights stays with you etc as above

Have a look here, it's really not that complicated:

Appreciate what you are saying about having the my son stay over...trouble is he lives in Worthing (South coast) and i am up here...they do allow me a bit more for petrol....about 40 allowance for travelling down there to see him.

To be honest Clare and i spoke about this last night and we have worked out that if she takes her maternity leave early then her pay will go down she can then become a depandant on me...she doesnt go back to work so we can sell one of the cars...(probably my chim) and we can go back to the lifestyle we had when clare was a full time student.

If someone can explain to me what the point is of progressing your lifestyle is just to have some jumped up dictator take it all away from you then please drop me an email...!

I don't understand why they are taking Clare's earnings into account at all - my understanding is that the new CSA rules should be set against your earnings only - I would challenge CSA hard on why they are doing this.

By the way, I'm no solicitor or expert, so don't take what I'm saying as gospel, but I've been through this process myself in some detail. I actually found the CSA phone helpline very good when I was trying to figure this stuff out myself: www.csa.gov.uk/new/contact/helpline.asp

They won't talk about your specific case, but people I spoke to on the helpline were happy to take a question from me along lines of "So for example, if I earned £x/month, have 2 children who stay 2 nights/week with me, and I have one other relevant child, what would my payments be ... and would my new partners pay make any difference to this" - ie a question which basically matched my circumstances.

They are taking clares wages into account because my ex wife has asked them to...!
But guess what...i have asked them to return the favour and they have said if her partner doesnt want to give his details then he doesnt have to!!!

I was told that if i did not give Clare details then my payments would go up!!!

And yes you are right...under the new ruling i would be paying less but guess what???
I can only get on the new ruling if my ex-wife asks to have me put on the new rules!!!
I cant ask to be put on the new rules!!!

Good the way it works isnt it?
I can honestly understand why some blokes have taken extreme action due to the CSA.

I just had a conversation with some guy from the csa who has just told me if clare didnt have her car we would have more money as she has got a loan for her car!!!

Is it still illegal to shoot people from the CSA or did i dream the law changed last night?????
