WARNING NE GARAGE DOOR ROGUE TRADER!!
Discussion
I thought I should post a link in the NE section of the forum to act as a warning to others considering having a new garage or workshop door installed in the Sunderland/North east area.
Just make sure that the installer is fitting the door in line legal legislation and is qualified to do so. The installer that I have had issue with is not named due to name and shame rules on forum, but if anyone would like to know the name of the installer from the Fullwell area of Sunderland then the information will be available via PM..
as a rough guide - a faulty door (numerous faults) under 11 months old - an installer who attempts to ingnore it and string it out until the 12motnh guarantee period is over and finally admits the door is faulty, but then states he doesnt care and wont do anything about it.
He is then threatened with legal action and offers to replace the door, but also states that even if it is faulty within 24 hours he wont do a thing about it and I would have to accept tghe replacement under those terms or he could offer a full refund. So i opt for the refund and arrange/order a new door from another supplier. in the mean time finding that the existing door is actually not even fitted safely or within legal legislation for such a door. I receive a fitting date for the new door and call the original supplier to inform him of the date he can remove his door and give me my refund - he then replies thats fine, but you will be getting your refund minus £460... if you dont like it then please contact my solicitor.
I have never ever dealt with a company that supplied goods then simply washed their hands of them and completely ignored any guarantees .. of the 5 other installers who came out to quote for the replacement not one of them could believe the situation...especially when they inspected the existing door..
I well be starting court action and contacting the Health and safety executive (who I have since found he has already had problems with recently), trading standards and The Door and Hardware federation on Monday.

You're assumingfiretly they turn up and secondly they'll cough up if it goes against them.
Don't hold your breath.
erm, no im not, if they dont turn up the case automatically goes against them.Don't hold your breath.
Whether he pays up or not is anyones guess at the moment, but the fact that the case is intended to be persued against him as a sole trader as its impossible for me to have a contract with a limited entity that i didnt know existed (with evidence to back that up), should sway him in favour of paying... he wont like high court bailiffs calling at his home..

Assuming any assets are in his name .Whether he pays up or not is anyones guess at the moment, but the fact that the case is intended to be persued against him as a sole trader as its impossible for me to have a contract with a limited entity that i didnt know existed (with evidence to back that up), should sway him in favour of paying... he wont like high court bailiffs calling at his home..
Be very wary about throwing good money after bad.
Trust me I've been there.
I took a garage services place from London to small claims court for providing defective (second hand)parts. On the face of it a hard case to prove but I went anyway.
They didn't turn up and the judge just awarded against them. They didn't pay so next stop was a court order, the balifs went in to their premises and I got the cheque for the parts, the expenses and other costs too a short time later.
Too much shoddy work in this country because we are prone to bending over and letting them shaft us.
Best of luck with it, please let us know how you get on.
