I don't think I'd have been overly offended if somebody thought my family was perfect enough to use in an advert. It's not like they're using it to advertise unsavoury products or services, in fact quite the opposite. I can imagine there would have been a degree of initial shock, but as the photo was already on the internet I think they created any invasion of privacy.

Lesson No. 1: If you want to keep your life private, don't post it on the World Wide Web

So are you saying theft is acceptable?
Just because an image is on the Web doesnt mean anyone can use it. If I leave a bike on the front lawn it doesnt mean anyone is free to use it.

(Ok in the real world, taking images without the owners permission is a continual problem) If I find images of mine used without permission or no link back to my site I do something about it including in one case having a site closed down when they refused to play ball)

We're to believe it was randomly pinched from a blog post ? I'm calling shenanigans.

The image in the window appears to be of reasonable resolution and several feet across (judging by the reflection of the cars), my money's on Ms. Kelly having uploaded the original image to a stock site.

Also, unless you're a head of state, just how narcissistic would you have to be to put your own image on a Christmas card ? yuck

technically not - theft removes the original. This is copyright infringement

Models/subjects don't have any say in what the photographer does with the image. You don't need model releases in the UK. Stock sites tend to ask for them as they sell internationally, and you DO need them in the US.

It's a guide to the intellectual property offences. That's why it says "IP crime> Awareness and resources> Guide to offences" at the top. I'm at a loss as to what you found confusing.

No, it doesn't, but I suspect the number of people on PH who are well versed in Czech copyright law is fairly small.

Equally, I'm at a loss as to why you think UK law applies to the USA? coffee

readit "It's a life-size picture in a grocery store window in Prague - my Christmas card photo!" said a startled Ms Smith, 36, who lives in a suburb of St Louis.

readit The Smiths and the photographer who took the picture, Gina Kelly, say that no permission was sought or given for the photograph to be used.
