Hi guys,

Just a quick one for any photographers who attend track days and car events.

Please feel free to take a look at http://www.trackphotos.co.uk - a website dedicated to track day photographs. Feel free to sign up and maybe help pay for that next lens!

Many thanks,
Paul.

I can't find the Terms and Conditions (the link on the sign up page doesn't work).

Do photographers need permission from the track to sell photos?

Hi,

This should now be corrected...

As for the right to sell photos, in the UK the photograph is property of the photographer. The only issue may be if you have a media pass which specifically prohibits the commercial use of photographs taken.

For general trackside photos, there should be absolutely no restriction that I am aware of!

Kind regards,
Paul.

You will need permission from the track to sell any pictures.

my site www.trackphotography.co.uk

You won't make any money.

apart from needing permission from the tracks and TDOs, your T&Cs unfortunately look and read as if they've been copied and pasted and modified badly from a template somewhere?! You'll need to ensure that not only do you get relevant permissions but also get the T&Cs sorted out!!
I'm also a bit confused how your T&Cs claim that www.trackphotos.co.uk own all materials and copyright etc despite you selling pictures on a commission basis for other photographers..

The photographer signup page specifically states that the Photographer retains all rights to material. It also specifies that the Photographer must own the rights to the images.

I am not trying to make money from this website, just try to provide a service to photographers and competitors. The aim is for the website to be able to support itself. Constructive criticism is of course appreciated!

I currently cover the hosting costs... Hopefully the site will be able to pay for itself long term.

Ah, so you take a cut of the purchase price then?

read the back of your ticket next time you're at a race meeting - they almost always prohibit you from selling your trackside pics, I assume it is the same at track days. Usually the copyright is owned by either the track or the event organiser (e.g. MSV etc.), with your pictures allowed only for personal use.

good luck with the project, but you may find it's not worth the hassle...

Most tracks are easily recognisable - if the track finds images being sold without permission it can take legal action against the photographer or person selling those images.

In the context of this particular forum thread, the circuit would have to look no further than the link in the first post to find people who are breaching those terms, and go after them as they see fit.

On that basis - pretty easy to police! Whether they would actually choose to do so, would remain to be seen.

Last time I raced at Donington they had some ridiculously draconian regulations on what I could do with the in-car footage, including not being allowed to upload it to the internet. I told them to stuff off and I haven't raced there since. Personally I find it galling that my 165 quid entry fee for a 15 minute race doesn't allow me to post the video on Youtube if I want.

What a bunch of twits.

you'd think so, but i've heard of guys on other forums who've been contacted by officials (in this case I think it was for some MotoGP pictures they had up on their wesites) with the option of paying £1000+ for accreditation for the series or removing the pictures from sale (all with threatening undertones of course!).

i expect they just google "donington+pictures+racing" or whatever when they're having a slow day and see if they can scare anyone into paying.eek
