I will be getting (well, trying to find) a photographer to take some studio pictures and want to know what precautions I should take against future publication of any of the pics. Contract? I have read on the forum about the model release form but doesn't this apply to letting the photgrapher publish the pics?

If payment is made for the services can I request full copyright of the images?

It's up to the photographer. Most pros always retain copyright and you use the images under licence agreed at the time. No doubt you could ask him to sign an NDA or similar if you're concerned.

I guess you're looking for someone in Switzerland?

If you're commissioning the photographer to work for you don't you own copyright, anyway, without having to stipulate it in writing?

Failing that, and lengthy contracts, can't you get someone from here to work with you on your project? Plenty of talent here, as well you know.

No. Handing over money is not connected with copyright. Strange but true.

It's all negotiable, just agree something in plain English stating who has what rights over the images. If the photographer is unwilling to agree your terms, find another one.

What are the pics going to be of? Do you promise to post pics on PH?

There are multiple issues here. (1) Who owns copyright? (Photographer unless otherwise agreed.) (2) Can photographer reuse images without your consent? (Not necessarily related to copyright ownership. Would you e.g. allow use for portfolio purposes? If you commission work for private purposes you may have the right to prevent reuse even if you do not own copyright.) (3) If you want to use photos for commercial purposes, have you purchased the copyright outright or secured an adequate licence? If the latter, then you have to ask for example what territories are covered, what uses are permitted and for what timeframe? (4) Have you secured a waiver of moral rights from the photographer?

just find someone you trust - last time something like this came up everyone went all pissy (the Scotland helicopter trip) which is frankly daft.

If you are wanting them for personal use you just pay a tog so long as you trust them it shouldnt be an issue or if its really that important to you you pay to own the images, you provide your own film or digi card and you leave with the originals. No one really should have an issue.

Should I be worried by your moniker? biggrin

So, from the gist of this and the other messages it seems I should find someone I trust rather than going down the professional route. Don't fancy the wifes pics on the interpornweb.

lol that was just down to a thread running in the Pie and Piston mad

I wouldnt say just go find an am, get someone who is good and who you can trust but most of all make sure you see their work too. Its all too easy to just end up with readers wife quality of shots.
