The answer is yes and no.
Supposedly it is part of the crash structure, but how effective an exhaust would actually be in a crash is debatable. I have changed mine and I don't think it has been a concern of any VX owner I know.
In any event, a rear shunt would have to get past the engine to seriously injure a driver.
