I've just been told that if you receive 6 points within 2 years of passing your test, then you receive a ban under the totting up rule?

Is this accurate?

If so, I can't believe it! Dammit, the attitude to traffic policing policy HAS to CHANGE.

The Road Traffic (New Drivers) Act 1995 came into force on 1 June 1997. As a result of this Act, each driver must go through a probationary period of two years after passing their first driving test. Drivers who are convicted of a motoring offence during this probationary period, and as a result have six or more valid penalty points on their licence, will have their full entitlement to drive all categories revoked. Valid penalty points incurred prior to passing a test are taken into account if the driver commits an offence during his probationary period.

Full entitlement to all categories of vehicle held previously will be reinstated upon passing a test in any one of the driver's original entitlements. LGV and PCV drivers may be subject to further action from the Traffic Commissioner. Passing a test will not remove the penalty points from the licence; therefore, drivers who go on to incur a total of 12 or more valid penalty points will be disqualified.

There is no right of appeal against revocation under the New Drivers Act. A driver can only appeal against the conviction for which the penalty points were awarded.

Unbelievable.

With 14% of drivers in London being nicked for 1 offence per year by 2003, then there are going to be alot of upset and unlucky new drivers out there.

It isn't so much the rule that upsets me, it's the attitude to punishment that raises my hackles.

Grrrr.

How much of a bad driver would you have to be to get points before you pass your test? Would the "responsible" person in the passenger seat get done as well?

I seem to rememeber that if a learner driver gets an endorsement then the "responsible" passenger gets the same endorsement on account of the fact that they are meant to be keeping the learner under control (so to speak).

Fair enough if its dual control but if its not and the learner gets done for speeding then why should the passenger? The one thing that they can do is instruct the driver but they dont have any control at all.

Everyone should but dont want to / cant afford it. As the law stands it doesnt have to be a qualified instructor in a dual control so surely it isnt right that a passenger has to pull on the handbrake comin upto a speed camera? I was lucky coz where i learned to drive there isn't any cameras so you could drive in (relative) comfort knowing you wont get caught

I’m very tolerant of learner drivers (we've all been there), but I think people should have to have some sort of training before they are allowed on the road, like the CBT for motorbikes conducted in a safe area where someone could learn to start/stop the car away from public roads.

totally agree. driving at 5/10mph, stalling all over the shop, swerving (especially when changing gear) could be stopped by bringing in basic training in a safe environment. my dad had let me drive in car parks for years before i started taking lessons, so when i was 17, i could 'drive', and start learning about driving on roads straight away.

I already know someone who's been caught out by this - he's been reverted to a provisional license..

Agree. I learned the basics of car control (no, steering/gears/clutch etc, not hanging the back end out) driving up and down the service track at the golf course my dad was a member at, during 'off peak' golf hours
My step-daughter is about to learn to drive, and has booked 5 hours worth of simulator before going near a car. Pretty sensible if you ask me.
I wondered if there was a decent 'learn to drive' PC software package that came with a steering wheel/controls kit, rather than a GT3-type game?

It is true I'm afraid. Been there, done that, bought the T-shirt.

Here's my story: (As they might say on Trishia)
February 2000, 17th birthday woohoo! Start diving lessons straight away.
April 2000, pass theory test Can you believe people actually fail it
May 2000, passed driving test at first attempt , 7 minors, joyous times ahead
April 2001, 2 o'clock in the morning. On my way home, behind a landrover and a 3 series doing about 60. Dead straight wide road with the odd building every 100 yards or so. All of a sudden, Blue lights fill my mirror (Ted we need a smilie for "Just sh@t myself!") Pull over, sit, wait, sh1t myself some more. Get escorted to the back seat of the T5. Get the usual patronising police speech: young drivers, powerful cars (Rover 25, yeah right), speed kills (not comment required), dangerous conditions, no wonder insurance is sky high etc. I'm all yes sir, no sir, 3 bags full sir. Apparently I was doing 59.82mph (How do they measure it so accurately?????? . If I'd have been doing 60 they'd have taken me to court. Counted myself lucky and went on my way VERY slowly. In the end 3 points and £60.

Anyways time passes... Finish A-Levels See David Beckham in a kebab shop (thats another story) and get a job for a year out before university. Obviously being careful because I'm aware of the 6 points and you out rule.
October 2001, Mum gets an NIP through the post saying the car was photo'd going through a red light. Sends it back naming me. I get the next NIP. (BTW I do not condone jumping red lights and I will never do it again ) Eventually get another fixed penalty then a few days later (Day before Christmas Eve )a note saying my licence has been revoked. is one of the words I used.
Anyway I have to pay the fine (£60), apply for a provisional licence (£27), book a theory test (£12), get a practical test (£38) and get a full license (£8). On top of this I had to stop my part time job for 3 weeks, used up all my holiday on my main job (Public transport won't get you twenty miles for 7AM so had to book days off while I had no license). Fortunately I only had to wait a week for my theory test and two days for the practical test, otherwise I would have lost my main job.
So all in all the six point rule cost me well over £500 which is close to a 3 weeks wages for me , loss of mobility for about a month , serious piss taking by my mates and worst of all missing the Macc Town vs West Ham FA Cup 3rd round match (No car to get to Macc and no trains or buses running that Sunday from where I was).

So the moral of the story is kids, don't lose your license it just ain't worth it.

Well I can sort of see her point really - would you want to bring your kids up thinking that they can avoid the consequences of their infractions or would you want them to learn that they have to take responsibility for their actions.. ?
