HELP ME! SummonsSect 84&89?
Discussion
I get back from a week in Tenerife to find a summons for 1st May last failing to give information! I have never had any letter and I have to go all the way to Marylebone Magistrates this Thursday to say so! Any advice please? I have trouble remembering last week never mind five months ago...how do they exprct someone to remember who was driving a car five effing months ago? Where was I? The car etc...If they wrote to me by recorded delivery I would have got their letter? Do they? I have no letter if I had got one I would have dealt with it...HELPPPPPPPP!

My sister had the same earlier in the year. She was told by her solicitor that first class post is considered to be good enough that 'post guarantees delivery'. She pleaded guilty to the offence but not guilty to failing to respond and got stitched. £320 + 3/4 points for jumping a red light.

Thanks for that! I intend to plead not guilty to the only thing I am in court for tommorow failing to inform! If they find me guilty then I am facked on the offence anyway...I will post how I got on as and when!!!

Sorry folks but was simple! Turn up steaming and I mean i was ready for a real row! They just rolled over! They showed me two letters and I said no I have never seen these...and what is worse I only got back from Spain last Saturday after a week away and if I had stayed for two weeks you idiots would have convicted me in my absence! A shower! A disgrace! A bloody lucky escape for me! Good luck all!
You got to give more details than that

A friend of mine is a CPS prosecutor, their workload is so horrendous (20 cases per day...) that preparation is often limited to scanning the file a couple of minutes before arguing the case. So if a spanner is dropped into the works at the last minute, the prosecutor a) may not be able to counter b) may not want the hassle, and c) would not like to appear an idiot in front of the court. Result - cases that are not 100% 'open and shut' can get dropped. Good news for speeders, but not so great for us all as most cases are scumbag petty criminals.
