What's the public view...?

Received an NIP for doing 51 in a 40. Been offered a 3 point FPN. I already have 6 points and suffered a periods in the "shanks" (14 days in 1998). The 6 comes off in October 2003.

Do I: swallow the FPN & drive veeerrrrryyyy carefully until the 6 come off...

or:

Not reply to the NIP, hoping that I never hear anything... (backlog, etc). If I do this, do I get a second chance with a NIP reminder letter? Will one definitely be sent? and will I still get the FPN offer?

I'm just worried that if I take my chances I'll get a summons and get clobbered in the dock.

There's a pint in it for everyone, if I get off!

I'd accept it. Court will probably look at your record, and hammer you.

Post your question to Mika, as there are several things you may be able to do.
Dont roll over , thats what they expect.

Accept the NIP, go to 9 points and drive carefully.

I wouldn't risk going to court because as northen boy says they will probably hammer you because of your previous. They would most likely dish out 6 points instead of 3 and you would be staring a ban in the face.

With your record, they'd think you were being stupid trying it on. Therefore a double bluff scenario. If it comes to court (which it won't, as they will send a second letter first), simply say that the first didn't arrive.

Or say that you sent the requested info off, in standard post... and you have a photocopy to prove that you filled it in. Before burning the original.

Either way you're covered.

And if it "times out", you've won, doubly so.

So what's the problem?

It's your choice, but go to court and you should NOT rely on 3 pp. With your record expect 4 or 5, or a ban if the bench misse dout on his nookie last night. At best you will be driving so carefully, you'll feel like the driving examiner is right beside you. Challenge the system, OK, but be aware of the risk

funny, I was told by Traffic that although the fine may go up, the points wouldn't. Which persuaded me to go for it. If you beleive you are innocent, or atleast - beleive you have a good chance of casting doubt on the accusation, there should be no reason why the penalty increases.

Bit like standing up to the school bully. Give 'em the sweets and only get thumped once, or try to keep them, and get thumped 3 times.... just proves the system is unfair.

Thanks for the advice.

@ the moment, i'm swinging towards Hertsbiker. The way i see it, it's got to be worth a try (just as long as i DO get a second chance via the reminder letter)

I'm thinking as a worst case scenario: they don't buy the "post" thing, i go to court and grovel.

Against: history. period.

For: last offence happened over 2 years ago, change in jobs that needs a license. Because of this, i have slowed down a lot.

PROVIDING i don't get a ban, i'll be borderline ban for only a few months anyway as the 6 come off in Oct 03.

Am i living in the clouds with this plan...?

At the end of the day it's your licence, and you have been offered the chance to keep it with the NIP. I wouldn't expect an easy ride if it goes to court because of your history.

It's up to you.

Check the credability thread.

BE consistant. DEMAND your rights, INSIST you are telling the truth. Even if you're not.

Yeah court is harsh, but been twice now, got off twice. It gets easier, which is something the crims will tell you. Don't know if that is a bad thing or not...
