Here is a wierd one.

About 9 months ago, mate of mine was coming back from Exeter to Reading down the M5 -> M4.

He said that about half way down the M4 he saw 3 people in bright jackets standing on the motorway bridge. About a week later he got a NIP for doing "98 in a 70". This was accurate as he said he was doing about 100.

He sent that back and got a court summons. He pleaded guilty by post.

Here is the wierd thing. They just fined him £100 quid. No points. Just a £100 quid fine. I saw the letter myself.

Why did they do this? Is it because they didnt have enough evidence or somthing? Is there a trick that maybe we could use for future circumstances like this?

If they asked him to write a cheque was it to

Court Associates Speeding Highways - or just CASH for short ?

Sounds like a scam - where did he send money to or how did he pay - if it was over a phone line I'd be even more worried...

do you mean you called the court and checked he really was supposed to be there or he got a very official looking piece of court paper telling him to be there?

This just isn't possible within the current legal system, (though I suppose that's only in theory). The cant NOT give him points but fine him - it just isn't an option open to magistrated except in special circumstances which you have to go to court to explain.

Sounds like a clever scam to me as well.....

But how did they get correct name and address? Certainly not by any legal means if it's a scam.

Very strange.

Now, does he go to the Police and 'fess up to see if it is a scam. Or does he keep quite a believe he got away with it?

I think I'd go to the Police to check it. If it's correct then I doubt there is anything they can really do to change the sentence. If it's dodgy they can investigate how someone is able to get his details etc from the PNC/DVLA.

No points = probably scam

Details are easily obtained from DVLA, cost about £5. Just tell them there is a legal dispute, equals good reason. Its how cowboy clampers, service stations etc. all enforce payment now.
