Just had a ticket sent me, it had another persons address under my name, driving a car that is not mine, which also doesn't belong to the person who lives at the address.

Surely i have a get out clause on this one.

Can anyone help?

I am experiencing virtually the same. Address was right however - not my car I was not regd owner either. Last owner was in fact relative ! NIP turned up 3 months after the alleged offence. I have written a letter to them explaining it and returned their NIP unsigned as It clearly does not apply to me. It may be that to comply with their desire to have you sign it you should scrawl see covering letter across it when returning it.

Did the owner of the car give your details as a possible driver at the time of the offence.

The matter of incorrect address probably means very little if this was the information supplied to them and the NIP has reach you anyway.

As for the timescale I think this only applies to the registered keeper of the vehicle so if they have fingered you then the limit is up to six months.

I got one sent to me a year or so ago for a W reg fireblade being reported for "no tax" it had my name and address on it but I had never owned or been the registered keeper of the bike, I sent it back stating exactly that and never heard a thing since.

There is a bit more to the story but i can't really go into on here, enough to say I had a good idea who's bike it was and why they had my name but I didn't lie and just said "This is not my bike, has never been my bike, I am not and never have been it's owner or registered keeper"

Just send it back saying "I have never owned/driven that car"

that is a damn good question!!

Sounds to me like smoeone you know has sued your details to get out of something - which is a good plan as you cant be done for it and neither will they!

Well, i have driven the car once or twice but it's not mine. The person who lives at the address knows who i am and sent it directly to me.

I thought that if the address and name didn't match then i could have a get out clause?

Ah, "now I see" said Stevie Wonder. The NIP will have gone to the registered owner, he/she will have notified back that you were driving at that time and they would send you a new NIP (this works, I dibbed on the wife). It may be that he did not fill in your address which is why the correct one is not shown.

If you say that the address is wrong, my guess is that they will correct it and issue new NIP. If you deny driving the car they will go back to the owner / try to identify from photo etc.

If you really weren't driving at the time stated you have a case, if you were then.........
