I have 9 points on licence 6 of which come off in november 02. I have been sent an ipn for doing 40 mph in a 30 mph this happened on the 22.10.02 when judging this offence do you think they will pass judgement on the basis that i have nine points or 3.?????? What do you think the outcome will be????? When would the points be added? at the time of the offence or what??

'Fraid from experience that the points on your licence at the time of the offence not the hearing is what counts

but for totting up purposes???? what happens then? be very interested to find out. Please keep us informed.

totting means as it says. If you have 9 points and get another 3 within a 3 year period then that makes 12.

When you say come off do you mean they are 3 years old in November 02 or 4 years old and hence can actually come off your license?

I may be able to help as I have just been through it.

Had 6 points for IN10 which the conviction date was 16/09/1999 and the offense date was 27/05/1999.

Then a furhter 3 SP30 points (f**king cameras) on 30/03/2001 which would give me 9.

I got caught speeding in wales on the 01/08/02 which puts me right in the middle of those 2 dates, 3 years later on.

They take it from the date of offense NOT conviction UNLESS the offense was for drink/dangerous driving. Then it is the date of offense.

I was ok as the IN10 points OFFENCE DATE was 27/05/99 so under totting up rules I only have 3 vaid points.

go to the DVLA website and look under license then endorsements. Its all there.

Totally agree with the above...... I went to Court and was asked if I had any points to which I replied 'no', which was true on that day as they had expired one month earlier.

Then was given 6 points for speeding and the judge announced after looking at my licence that I now had 12 !!!!! FFS they make these rules up as they go along [wink]

managed to keep licence after chatting her up which took ages ......

left court and effectively had 6 points in total !

How ridiculous is that.

When i first phoned the Fixed penalty office asking the question, no one could give me an answer.

It took me 10 phone calls and speaking to a senior magistrate to get the correct answer. One woman even said that it depends on the mood of the magistrate!!! I even had a solicitor standing by in case they tried to "change the rules"

Anything for a bit of cash eh? These people are ruthless.

This is a common mistake. Have had solicitors appear and not know the rules, in effect telling the court their clients have "extra" points which if not checked by the court, would often lead to their clien's disqualification.

The moral is ALWAYS check yourself.
