Fixed term apprenticeship - contract after
Discussion
My son completed a apprenticeship in may, the apprenticeship contract was for a fixed term until the 31st of January.
The reason for the extension was that the company that did the exams was a bit slow and unorganised.
He's remained at the same place since.
Is this a problem for him?
I'm assuming he is still protected under employment law etc.
The reason we looked at the contract was that he was refused a day's annual leave, he understands that they could literally give you a days notice for a day off or 7 days notice for a week off

If he has an employment contract then he's got standard employee rights...but the big question there is when did he start? (As anything less than 2 years service and your rights / right of redress are limited)
I'm not sure I understand the last half - employers are quite at liberty to refuse a request for leave, especially if short-notice. But are you suggesting they can dismiss him or tell him not to come to work at short notice?
(this suggests your son may be on a Zero Hours Contract, which is a rather different animal)

Which bits of Employment Law are you asking about? Or, more specifically, what are you worried might happen to him?The reason for the extension was that the company that did the exams was a bit slow and unorganised.

last i looked at this as a general rule, you should give a minimum of twice the notice period of the time you require off and the employers can reasonably take half of that period to approve or decline. The employer must have have a genuine reason to decline, the earlier you get a request in the harder it would be for them to decline without potential comeback as they have time to plan accordingly.

He is no longer working under the apprenticeship agreement since it has expired. When that expired he should have received a contract for employment with all terms and conditions included, this should also be covering hourly wages/salary payment at the national minimum wage or higher. This should state leave entitlement and notice required for leave purposes. The reason for the extension was that the company that did the exams was a bit slow and unorganised.
