Earlier in the year I got caught speeding and received an NIP.

Paid the fine, posted the license… heard nothing.

Last week I received a summons for not submitting my license and today they refunded the fine!!

Ok, with hindsight I should have sent it recorded or something and had no faith in a Gov service I pay for (post office), but anyway… I’ve explained all this in my submission to the Court. Do they usually accept that?

Also, do they actually endorse the license anymore? It’s a photo one so I assume the points link to the license number not the physical license itself?

It's Royal Mail and it's not a Govenment service.

I thought sending licenses in stopped nearly 10 yrs ago!

The court just tells dvla and they tap a few buttons on a computer and like magic the points and endorsement are added.

Why would DVLA want thousands of licences sent to them every week, all that have to be returned !

My experience also.

2 events over 45 years apart & neither needed the licence posting to them.

Did the OP say they'd sent their licence to DVLA?

ETA: assuming that's what they meant when saying license

I don't know whether you mean you physically submitted your licence. There has been no requirement to do so since (IIRC) April 2015. In any event, there is a requirement to submit your licence details and the police, for one reason or another, do not have them. Hence the court proceedings (and I imagine you have a "Single Justice Procedure Notice" rather than a summons).

You should respond to that and you have two choices:

You can plead guilty to the charge and in the "mitigation" section of your response, explain that you that you did submit your details and they must have not been received. As a result, ask the court if they would sentence you at the fixed penalty equivalent (there is guidance that suggests this might be done if the court thinks fit).

Or, if you definitely did send your details (and there may be a problem getting the police to accept that, if you sent your licence instead of just your details) you can plead not guilty and defend the charge using s76(2) of the Road Traffic Offenders' Act. This says that no proceedings shall be taken against a defendant who has complied with the requirements of a Conditional Offer of a Fixed Penalty.

Before you consider this option, it would be a good idea to check that you you submitted your details in a manner satisfactory to the police.

There will almost certainly be a post later suggesting that what I said is either wrong or unreliable, so I would wait until that appears before you decide what to do.

I asked similar in 2022. Was told it was procedural, Met Police need to see the licence. Stupid, imagine how many go missing being posted two ways or more.

Some do some don't, it required a change to the legislation which was going through and then got shelved due to some election shenanagins a few years ago and has not been resurrected. North Wales for example don't ask for the licence aymore, just the details, whereas the Met still ask you to send it I believe. A bit of a mess really

Yes, paperwork specifically asks me to send in my license. I thought it was pretty 1990’s myself but complied anyway… and now this BS! 🤦‍♂️

RM hasn't been in Gov hands for a long time now - it was fully privatised around '11 / '12, and the last remaining share(s) they had were sold around '15 iirc.

OP obviously missed all the news a few months back about the pros / cons of Daniel Kretinsky and his plans for a 100% takeover (from his current shareholding) of RM. Think it was agreed but not sure if either the previous or current gov signed off on it yet.

The rest of the reply is a cut and paste from pepipo. Total nonsense, as usual.

OP, ignore this walt. He isn't qualified to give legal advice.

The correct strategy wasn't one of the two choices outlined by walt. It was to contact the police prosecutor before entering a plea. Possibly a bit late to do that now.

Well what a waste of time! It went to Court after they refunded my £100 fine payment, and the result is a £100 fine payment and I don’t need to send my - lost! - license off! Comical.

It's not a license, it's a licence.

Try to remember - license is a verb. Licence is a noun.
