Does anyone have access to the judicial college guidelines on personal injury damages? If so could you give me an idea if an offer of £1750 is fair/the going rate for a fall my dad had?

Basically he fell on a dangerous floor in a rented holiday cottage causing the injuries below (as per the medical records) and the family holiday to be ruined. This is being dealt with without a solicitor on his side and liability has been admitted.

Have any of the lacerations left permanent scarring?

(d) Less Significant Scarring
In these cases there may be but one scar which can be camouflaged or, though there are a number of very small scars, the overall effect is to mar but not markedly to affect the appearance and the reaction is no more than that of an ordinarily sensitive young
woman.
£3,150 to £10,960
£3,460 to £12,050
(e) Trivial Scarring
In these cases the effect is minor only.
£1,360 to £2,810
£1,500 to £3,090

Probably about right if he recovered mostly fully in about 6 months or less

Any financial losses, what day of the holiday did it happen on?

Was Saturday to Saturday holiday and it happened on the Wednesday. As my dad is retired (he was 79 at the time of the fall) there weren’t any financial losses other than the costs of transport to hospital etc, which are minimal and can’t really be proved anyway.

In their offer they mention the injury’s but not the cost of the holiday (about £1200) which was ruined.

I wouldn’t accept their first offer. Maybe counter with £3k in full and final settlement of all heads of claim and maybe accept £2500.

I’d also be saying that if they don’t settle at the figure you’re looking for, you’ll look into instructing a personal injury solicitor and obtaining a full medical report.

Do people not have accidents anymore?????
Do people not realize that claims like this are why things cost so much.
While i feel for your elderly relative , it was hardly a life changing event, and at no real cost to you.
How does a check make it all better.
Just because everyone else does it, doesnt make it right.
If there was a permanent injury requiring lots of rehab, or a significant cost to you,why put a claim in???
We all pay for it at the end of the day.

I hope your father is recovering ok.
I don't know all the facts but surely if you had been in the house for a few days you and family would have known about the flooring.
I am curious , what was wrong with the floor to make it dangerous ?

true you dont have to state the reasons, but it might help us understand.
Im all for people being recompensed for losses, but it doesnt seem there where any, and what was dangerous about the floor?
