I received the letter this morning, the problem is that I share my car with my father. I don't recall driving that time; I think he was driving but he can't remember any anomaly that day. As far as we know we've not had any problems driving recently.

The letter says the allegations can be supported by credible evidence in court.

I have no idea what to do right now.

Any help would be appreciated.

Can you not ask for the evidence so that you can ascertain who was driving?

Who is the letter from? What evidence have they given? Ask them for more detail without naming any driver.

The letter is from the Met police, at the moment they are asking who was driving the vehicle but everything else is extremely vague. It doesn't state who the evidence is from and the specific allegation.

The location is close to my house but again doesn't specifically mention the exact location. It just mentions the road which is a very long road.

My bet is a close pass of a bicycle.

Reported by said bicyclist.

Supported by head cam.

It will probably be of no use to ID the driver.

Sounds like you are pretty sure who was driving - doesn't matter whether there's any memory of what happened. You are obliged to name the driver. Do that, he'll get a NIP/S172 notice and take it from there.

As far as OP’s opening words, it was ‘just a letter’. I think OP needs to be more specific about what he has received and what is being asked of him.

Ok just to clear it all up.

The letter is a Notice of Intended Prosecution from the Met Police. They are asking me to name who was driving (90% sure it was my dad and not me).

It's due to "Drive a mechanically propelled vehicle on a road/public place without due care and attention, contrary to section 3 of the road act 1998 and schedule 2 of the road and Traffic Offenders Act 1998."

It gives the time, date and location.

They state that the allegations can be supported by credible evidence in court.

You need to name your father as the driver at the time of the alleged offence.

Don't tell me, neither you or your dad have Timeline active on Google Maps on your smartphones..?

He's fine with it but he can't recall anything out of the ordinary. He's very sharp and normally tells me about a road rage incident or anything like that, hence why we're both a bit perplexed. The vagueness of the allegation is a bit weird.

He wants to request to see the evidence but I assume I can do that after naming him? or is that evidence supplied only when you go to court?

It's a really handy feature that keeps track of where you've been, day by day. It would help you decide who was driving without having to lie/risk prison/make something up.

I certainly don't and neither do most people I know - mind you the common feature of that is them using Apple phones rather than Google spyware.

Isn't the keeper of a vehicle supposed to know who drove it?

If they’re a decent and honest person, yes. Otherwise you have to prepare yourself for a long thread of ducking and diving and weaving and excuses and latest revelations and nonsense.

Maybe not on this thread.

Perhaps my attempts to keep my life straightforward and easy have succeeded where other’s lives are complicated through necessity.

Most people will only have 1 or 2 people besides themselves who drive their car I would imagine.
