Interest in a car after repair but before full liability
Discussion
Basically I haven't had any need of insurance in 22 years but a month ago, someone clearly liked the styling of the my boot spoiler and took a real close look.
I will try to keep this as brief and non specific as possible as the internet has ears.
1.) Third party drives into the back of my car. His car has substantial damage (air bags off, suspension pushed back.), write off basically. Mine is repairable. We are told by the attending officer that its all on the Highways Agency CCTV.
2.) Mine is taken off to be repaired.
3.) My insurance company is told that there is now no CCTV and within an hour the third party is now claiming joint liability. As he drove up the back of me, my understanding was that its 100% his fault but hey ho, the modern world and all that.
4.) My car is now very nearly repaired but I have been told that as he has claimed joint liability it could take up to 12 months to finally be settled.
So the question is, if my car has to be sold off in the near future will my insurance company still have an financial interest in it and therefore stop me from selling it as liability hasn't been settled? I am not expecting to have to sell it because I love it and I am very pleased I am getting it back but everything going on at the moment and an infirm parent who in her own words "could be a goner if she slips on the pavement," I don't want to be in the situation where I won't be able to realise the funding in the car if I need to in an emergency.
I do not have any finance outstanding on my car. (HP, PCP etc)
That's it basically. Any thoughts?

I'm not sure I understand what you're asking. Regardless of whether it's settled (and assuming you have fully comp insurance) they do not have a financial interest in the car.
They pay for the car to be repaired. They can then argue the toss with the 3rd party insurers about whether they should be paying some / all of it. But this has nothing to do with the actual car.

That's the wonderful thing about PH, answered almost immediately! They pay for the car to be repaired. They can then argue the toss with the 3rd party insurers about whether they should be paying some / all of it. But this has nothing to do with the actual car.
So basically they have an interest in the bill for fixing the car and getting the funding back from the other insurance company but they can't claim any money from any sale of the car. Just a question for them of how much money they manage to get out of the other insurance company.
Thank you for clarifying that. As I mentioned, its been a very long time since I've had an accident and that was my fault so it was much more cut and dried. The time before that was when someone went up the back of me at zebra crossing and there was none of this shared liability stuff, he hit me up the back, his fault, done and dusted.
This is why I have now fitted front and rear dashcams to both my cars....
I was hit whist stationary at a junction 18mths ago...no damage (bar a couple of minor scratches to an already scratched rear bumper) to my car, but his had a good size dent in the front panel and grille from my towbar.
He refused to accept responsibility so despite no actual claim, I have a claim on my record...I had to report it as he refused to divulge any details and drove off.

On what basis? He just can't say "I think it was half his fault". He must continue with "because........"His explanation of what happened is inventive to say the least…
