Kia Faulty issues on used vehicle

Looking for some similar experiences on this one not "How can you prove this isn't your fault etc" Apologies if the post is frantic but it's been a stressful set of events today and very very irritating based on the measure I've taken to originally solve the problem.
Bought Sportage with 23k on the clock (17 plate) last year and I've had nothing but things wrong with it to an unsatisfactory level.
They are mainly two problems the second one is acknowledged so far as a warranty problem so I won't delve into this;
1. Gear changes Reverse, 1-3rd are like jelly and audio wise you hear clunking
2. Whining noise from driver side front of the vehicle.
I reported the clutch gear change issue approximately a month after purchase in July 2022 to a local dealership (Bought this one at another one miles away), I basically got taken for a muppet and told its because of the AWD drive train and I "needed to get used to the clutch". With this I thought fk it I will just wait another few months to see as I was basically forced into no help at all.
With the issue persisting I decided to get this reviewed before the service today.
This is where the sht storm has hit. I took the bloke out and he was quite decent about it, he acknowledged the issue said he needed to inspect and drive it himself.
I get the call from the service handler "Mr FSD, your car is ready, based on Kia warranty for clutch only being 2 years (and not 7) the clutch we have established as needing to be replaced at the cost of £1100 would you like to book this in" (In October).
Once I'd got off the ceiling I kindly said I would phone the original dealership where it was purchased and return the call.
The car was purchased and I reported a fault under warranty before with the same problem, obviously the cars done more than original mileage (23k at purchase) now but it's only done 37k!
I'm awaiting call from the original dealership to discuss this but has anyone else had similar issues and problems with manufactures and used cars like this? Fortunately I have a full audit of action to resolve original problems.
I will add Problem 1 I mentioned earlier has been in twice now, the first problem they replaced as an Aux belt issue, and now they've adknowledge it again as a warranty fix but want it stripped down and booked in when available to do so.
It's not been a great experience I imagined with Kia if I'm being honest.

They'll tell you what you can do.
Give them the exact date you reported the suspected clutch fault to the dealer, (about a month after purchase you say)

I think I've got enough evidence to suggest I had the issue originally as I got poopoo'd when reporting the issue after a month.

That's how it reads to me. Which would indicate nothing wrong with it. I have an opinion on this. But I'll keep it to myself for now.

That's how it reads to me. Which would indicate nothing wrong with it. Customer took the car back to the dealer, about a month after purchase, to complain of the gear change not feeling right.
Was fobbed off.
Now some 12 months later customer is being told a new clutch required to fix said gear change problem.
The fault was there when he bought the car, and he reported it to the dealer a month after purchase.

You don't need to listen to what they have to say.I'll keep the post updated.
Tell them you reported the fault a month after purchase.
The same fault has now been diagnosed as a clutch issue.
Tell them you expect them to fix this issue at their cost.
If they refuse, get the work done and reclaim the costs from them.
Try to get this all in writing/email.
Citizens advice will tell you all about letters to send, and what deadlines you should give, and then the money reclaim procedures, if required.

It is a 17 plate car. You bought it at 5 years old. It's done a low mileage, that's 5 years of some bint driving it to the shops at the end of the road twice a day. Of course the clutch is shagged. It's a disposable service item.
The whining noise is 'buyer's remorse'.
The harsh gearchange will be driving it badly with a poor clutch taking its toll on the synchromesh. Abused clutch drags, loading the synchro. How much of that was there when you bought the car? and how much of that wear is down to the miles you've done?
Put a new clutch in it, the drag should go, but the wear to the gearbox will still be there.
You've done 15k miles in it, it hasn't actually blown up?
It's just another imperfect used car.

Yes you are as the problem existed 12 months ago (With another problem)CAB have told me that Burden of Proof is required to justify this.
If only the Kia After sales team will return my call to do this first after leaving two messages yesterday....

Clutches wear in use.
It's a used car, the clutch will have some wear.
This one seems to have a lot of wear, not unusual for a car driven on short trips, or driven by someone like my father in law.
IF the clutch had expired completely shortly after you'd bought the car you could have rejected the car.
That hasn't happened, the car still works in Kia-tastic kind of way.
Did you test drive the car before purchase? If so, you should have run a mile or insisted on a new clutch before buying it.
It may have been very low mileage when you bought it, but it's still basically a banger of an age where many manufacturers would not give much warranty on anything and the best you'd have got is a one year used car warranty, unless you went out shopping sepcifically for a warranty.
What car maker warrants the clutch for 5 years?
How much is a clutch? about a grand? that is a run of the mill bill for the joys of used car ownership.

What correspondence do you have from when you had the car looked at a month after you purchased it?An email booking relating to booking in for gear change difficulty?
A job sheet from the dealer relating to gear change difficulty?
An email to the selling dealer that it's being inspected for a gear change difficulty?
If you have anything like that, that'll be your proof that you reported a gear change issue with the car one month after purchase.

I'm being told clutch warranty is 2 years so I in the position where im seeking redress against the original dealer for selling me a faulty car.I spoke to the original dealer earlier and I am absolutely disgusted with them, I stated the situation and got basically given the same spill about clutch warranty and basically said they would do sweet FA about it.
I phoned back the dealer who has condemned the clutch as faulty and reiterated they told me nothing was wrong with it when I reported the issue last year (As they said about the other warranty issue).
So...I decided to knock there heads together with Kia complaints.
Kia were initially telling me the same about clutch and covering any eventuality but I've insisted the complaint is lodged to state the history seeking to resolve the issue and also the small amount of mileage it has done since purchasing the car.
Kia while on the call put us on hold, spoke to the dealer condemning the clutch and then said the dealer would get back to me about next steps.
I had a message sent over (working this afternoon) to send service history book to the dealership and they will send a goodwill gesture request to KIA.
Has anyone had such a request made? Is this likely to be another fob off?
