Got caught in my work truck by a mobile van on 13/1/2021 doing 49 in a 30.

Work received the NIP a week or two later, filled it in with my details and sent it off straight away.
Received my NIP a week or two after that. Again, filled it in and returned promptly.

I thought at the time it might take a while as I expected a summons or whatever it's called now.
It's been almost nine months and I haven't heard anything. I'm struggling to believe I've got away with it.

I understand that the 6 month deadline applies to the police notifying the court and not me, but a quick search on here and other forums found most people received a court notice shortly after that deadline.

Could I really have gotten away with this?!

Id be:

1) logging on to government gateway to view the license to make sure that nothing has been added (e.g. failing to declare) is on there

2) if the above shows nothing, counting my lucky stars as you've 90% gotten away with it (unless its been submitted to the court in time and there is a backlog - unlikely after this amount of time)

I've logged on to the gov gateway, there's no points and nothing pending.

I reckon it will take a year before I genuinely start to believe I've got away with it.
If it wasn't for Brexit and Covid I'd probably start to think I'm in the clear now.

49 in a 30 is still a fixed penalty £100 and 3 points

Assuming you have a copy of the original paperwork, have you tried contacting them? That would be the first place to start. if no information has been put to the court then it would seem to haven fallen down the back of the filing cabinet, go and buy a lottery ticket

This did happen to me in that I got the NIP a week before I moved overseas so returned it with the overseas address...never heard anymore.

Unless the law allows extra delay now due to covid, I'd think you too have a timed-out case.

Curiously, this happening to me (not being fined/points) since led to me changing my driving dramatically and with strict(ish) adherence to speed limits since. By not getting fined, I drive more slowly.

I've got all the paperwork but i don't think I'll be contacting anyone! I'd rather sit in motoring purgatory than risk prompting the conviction back into action.

I certainly slowed down for the first six months or so. But as work picked up and traffic got back to it's horrible self in the south east (actually seems worse than pre-covid), my driving has got a bit more speedy when given the opportunity. Definitely more conscious in a 20/30 stretch of road though.

Why? It makes no difference now, the offence has timed out, if no information has been laid with the courts it's way past the time that they can prosecute you

I got pulled up by an unmarked car that had been following me for around 6 miles (i didn't know it was police until he lit me up, but i was aware of the same car behind me for some time) on boxing day a few years ago. He invited me into his car to watch a video of myself, spent nearly an hour talking to me and then 'interrogating' my other half in my car whilst leaving me in his.

He offered me a fixed penalty, i declined as he wouldn't actually tell me what speed he was doing me for, he told me to expect a letter from the court.

A year went by, never heard anything.

I was either 'lucky' or he was just trying his luck getting me to admit to speeding as he didn't have any actual evidence that a court would accept.

i think they do it just to sweat you sometimes lol

The 6 month deadline relates to raising court proceedings, not an individual accepting a fixed penalty. So the whole get-out is if they take over 6 months to write to you, you can decline the fixed penalty and say you want court.

Did you receive paperwork in your name and respond accepting the fixed penalty/paid the fee? If so, they could in theory still add and process.

I had a similar situation where it took the police over 6 months to write to me (lease car and they just sat on my details when lease company shared with them). I wrote back declining the fixed penalty saying I wanted court, but as over 6 months, they couldn't bring the proceedings. I got a nice letter back apologising for the inconvenience.

Edit - just realised the speed would mean more likely straight to court and no option for the fixed penalty. If so, happy days. You should be all good smile

From your account I would say he had plenty of evidence, sounds like you probably didn't get gobby and passed the attitude test and he had a change of heart and thought letting you sweat for a few months was a far more effective punishment and it probably was

Stick to guitars, most of that is wrong

How so? I have said the same as you - offence has timed out for the courts. If you send back accepting a fixed penalty notice with payment though, they will still process it regardless of the 6 months.

Just to be clear, I sent the NIP documents back confirming it was me and that's where the trail ends.

I've not received any offer of a fixed penalty or any other form of communication.

If I dodged a bullet with this, it really was my lucky day.
I was completely unaware of the van but yet on the same day I past another where I know for certain I was over the limit by a solid 15mph or so. It was on the a41 dual carriageway between the M40 and Bicester. It drops down to 40 what feels prematurely. You know, one of those sections where it doesn't appear to make much safety sense and more of a cynical money making exercise.
I was just waiting for a letter each day, so when the NIP arrived for a different offence I couldn't help but fear for the worst. I thought I was looking a 9 points or so for both.
Nothing ever arrived for the Bicester episode, so if this one also comes to nothing I really am a jammy git!!

Just going through this, thought the same, was for 36 (might have been 37) in a 30.

I returned the NIP, identified myself then nothing for nearly 8 months, then I got a 'Single Justice procedure Notice' in lieu of a court appearance, I did not challenge the NIP in any way and was expectng a Fixed Penalty but this came through, filled that in nearly 8 weeks ago and still nothing.

So now await my fate, fine and points notification. !!

Sounds like they didn't get the NIP you returned (or maybe you didn't sign it, or something - there was a recent post from someone who "forgot" to sign it) although I don't know about the 8 month timing.


One of my colleagues got snapped at 102 on the M25, returned the NIP and never heard anything further. He was assuming a totting up ban as he had a bunch of points already.
