Following a bit of office banter... can anyone settle this arguement. You're driving along (being a numpty) and doing the following;

eating food, having a drink (not alcohol) and using a mobile...

... what could you expect by way of a slap on the wrist? Points? Fine? Ban?

This is just curiosity, since one person said points.. one said a ban... one said nothing... etc etc.

All depends on the officer dealing. It could be a slap on the wrist, it could be dealt with by way of non endorsable FPN(drive - not in proper control of motor vehicle), or you could be reported as Matt said.

Personally, unless there were aggravating circumstances I'd go for the FPN.

Interesting thought though - Its been in the papers about people being persecuted (ooops!) I mean prosecuted for eating whilst driving, but Ive never heard about anyone being prosecuted for smoking whilst driving.

Surely If you are eating a Kit Kat as you poodle around the M25 you are not in any less control of the vehicle as you would be if you were sparking up a B&H.

This one's been done to death in many threads, but I'll bite...

The passenger can see what's going on around the car and should know when to shut up 'cos the driver needs all his/her attention on the road.
