Three days ago whilst travelling through Birmingham in one of my works vans I was pulled by two traffic police. Now a turbo diesel Scudo Van is fast but not that fast. The basic of the pull was that my private number on the van shows as stolen on PNC (Police National Computer). I bought three of said numbers direct from the DVLA so I wasn't happy to say the least. We worked out that the theft was before I bought the plate amd it had since been returned to the DVLA and re -sold to me.
My concern is this;
1/ Should the DVLA have informed me the plate had been subject of a theft.
2/ Secondly it appears the original theft had some use of fire-arms as PNC I believe carries a fire arms warning against my number. In other words if I'm stopped again it could be a full on armed stop (guns at my head etc). This was advice from the traffic lad who stopped me.
I've contact the DVLA etc and been told it will be rectified, but due to the possible seriousness of this do I have comeback against DVLA (I darn't let anyone take the van out)

If you got it from the DVLA you'd EXPECT it to be fine... It might be worth giving the solicitor a call (but that's just me) to check how you stand - or ask a suitable PH'er..

The prospect of meeting an armed police blockade does not fill me with much joy... so I'd make sure the book was thrown back at the authorites for a change.

Yeah, but why did they stop you? I very much doubt that they "had reason" to suspect that your plate was stolen.

I thought a PNC check could only be carried out if an offence has been taken.

Seems a bit odd. Maybe you were speeding, and in the heat of the moment, when it was sorted, they forgot - good result?

Salty, PNC checks are completed before a stop to allow the Officers chance to find out what they need to know about the car/ van etc.
I'm going to consider giving DVLA hard time over this I'm sure they should have made the theft known.

Phil

I would consult a solicitor if I were you.
Especially as you are now unable to use the van and it is affecting your business.
You could have every justification for a claim against them. It could even be handling but you would have to prove the 'knowingly' part of that offence and I doubt that they would cough to that, although technically they must have known as they hold all the data about every registartion mark! so therefore they must have known.

Im with madcop on this one
PNC markers should be removed after the enq is finished
If they are not then the innocent - like yourself get the brunt.
A solicitor would probably get you an offer of compensation.
Sorry to say it might even be the polices fault if it was them who put on the marker but then didnt remove it.
A few enqs should get it sorted for you.
Dont like the sound of being stopped by an ARV crew ponting MP5s at you.
Ive just watched the Iranian embassy programme - MP5 Ouch!
