A long one I'm afraid

A friend (really) has the following Predicament
Any adive is much apppreciated

He went to to a pub with a few of his mates and had 2 pints. On the way home from the pub he gets into his car and another mate jumps on to his bonnet. Thinking this was a bit of fun he keeps going, (slowly) and thne brakes gently, mate who was on the bonnet slides off, but is only waering sandels and slips and hit is head onthe ground. People in the pub see young lad lying on the road and coming flying out to survey the scene. They called the police and an ambulance. The police come breathlise the dirver (who is all clear no readings on the scale) and the ambulance takes away the chap who waslying on the ground. He required stiches.

The police told driver they were doing him for dangerous and reckless. The chap who was injured spoke to the traffic officer who was in charge and explain the story i.e mates who were messing around etc and now they are charging him with aiding and abetting,

Questions are
1) Can they do this
2) how serious is this ?
3) What might the reaction of the police be ?
4) What can happen to the driver

Any suggestions is mcuh appreciated

How can you get done for aiding and abetting as a victim??????

I always thought it took the "victim" to want to prosecute the offender for charges to be made. If the mate in this situation just says he does not want to press charges than the case gets droppped?

That would've been my first thought..... but Plod can do you as the driver for dangerous/reckless if there is no victim.

My guess would be that they won't be able to make it stick unless they have some witnesses - I would suggest that your mate does nothing to make a statement/incriminate himself until he has seen a lawyer and make sure that his mate does the same thing.

Have either of them been cautined - if so, wot did they say? If after being cautioned they told plod what had happened, then I reckon they could be in schtuck! It was (in all fairness) a harmless prank, but what would've happened if after his mate fell of, his foot had slipped off the brake etc.... one squashed mate, hence the potential charge.

They might get lucky and plod may just be doing it to put the frighteners on them, but....... more info required. A saving grace was that they weren't "speeding"!!!

I think it'll be dropped, even though he could be prosecuted because his actions were clearly reckless / dangerous. But, is it really in the public interest......probably not.

In this case you can get done for aiding and abetting the drivers offences because without the person being on the bonnet, there would not have been an offence under these circumstances. I assume that the 'victim' climbed onto the bonnet of his own free will and was 'having a laugh'. He was inadvertently the main part of the offence.

yea but you got to admit the cop who nicked them was beeing a **** that day if thats what happened.

Does this mean that anybody involved in a RTA is aiding and abetting as the accident would not have happened if they had not been crossing the road?

Wanna bet?? You must've had the little scrotes who take great joy in playing chicken with you as they try n croos (or should that be block?) the road... just drive straight at them and DONT STOP! You can see it in their eyes - that feral look that says "Come on you bd, I'm harder than you"....... Mad world we live in, mores the pity.

True, once pursued a car that took a route past a corner where the local undesirables hang about. One particularly clever looking guy (not) stood directly in my way and put his hands out as if to say 'come on'

He moved in the end.
