HI

A friend of mine just passed his test last year. He was going to visit a friend of mine at Leeds university.

He claims he was trying to overtake a Citroen Saxo but the guy kept playing around and wouldn't let him past and kept cutting him up. He then let him past on a corner... or atleast appeared to.... they went under a bridge he floored his car to get past this guy in the saxo. As they came out of the corner he flew straight into a brand new safety cam (the type that's positioned in front of you and has only three thin lines on the road)...... basically he hit the cam at around 100mph. He couldn't remember the exact speed cuz he went from concentrating on holding the road to checking he was past this guy to lookin up and gawping at the cam. Anyway.... the guy was seriously crapped up for about 5 weeks after the incident and didn't have a good Christmas/New Year break from uni.

I've tried to console the guy cuz he was caught on cam just before Christmas.... but he's still crapping himself about a slip of paper coming thru the post.

What are his chances of getting away with it now? Is anything likely to come thru now that it's almost 6 months since the incident?

Forgot to say the aforementioned stretch of road was an NSL with dual carriageway and central reservation.

Fairly small now unless he has moved house or address within that time. NIP has to be sent within 14 days (not received) as long as its in the registered/recorded post within that time it is valid.

Some posts will tell you that after 6 months nothing can be done about it. Not strictly true either.

Statutory limit on proceedings in most traffic matters is six months except insurance or V.E.L. offences where it is 3 years.

This means that the information (written summons from prosecutions dept within the Police) is laid in front of a magistrate or magistrates clerk.

If this is done within the statutory time limit, then the summons is legal and can be served any time, even years later if the offender cannot be traced to have it served on him/her.

Your friend would have to keep on his toes for an awful long time to avoid it permanently if it was processed properly.

Sounds as though he has got away with it though.

he`s got away with it mate chances are there wont a film in it at the time.

he would have heard about it by now if he was going to get done

tell to stop worrieing about it.
