Summons where???
Discussion
I'm hoping John Robson and the like can help me here... is a summons sent to the address given by the driver when the NIP is filled out, the address at which the car is registered or the address on your driving licence? Since I have been in the process of changing the last, I wonder whether my non-receipt of summons is down to it going to my old address...
NIP was done at the road-side (I think that's what it was - it also asked me on the back to produce documents at police station). It was the summons I was wondering about. I am hoping it goes to either (a) address I gave when NIP was filled out in back of car; or (b) address to which car registered. I have been in the process of changing address on licence and would hate for it to have gone to the wrong address without me knowing. I intend to go to court and do not want to be seen as having contempt for the process. Then again, I'd rather not write and ask for a summons!
Ring your local force's main telephone number. Ask for their file preperation section (they may ask you why, just tell them.) When you get through, tell them your concern, they can then amend it. Keep a record of the telephone call, that way you can show you made all efforts to inform of change of address. It will also help you no end in court to show you've done your best not to waste court time.

I can't claim to be an authority on this, but I thought the 14 day rule only applied to Gastos.

The system works in the following way.
1. The NIP must be issued ( not necessarilly received ) within 14 days of the date of the offence.
2. The information of the offence (except for excise and insurance which is 3 years)must be laid before a magistrate or magistrates clerk to be signed within 6 months of the offence.
If the information abou the offence is not done so then it becomes out of time.
3. Having had the information laid before the court, a summons is then issued (signed by the magistrates clerk or the magistrate)
4. Once the summons has been issued within the time limit, the Police have ad-infinitum to serve it. Could be years later if you bog off to somewhere else out of the country.
I hope this clears up your 'a friend of a friend told me'problem

i was in the same situation - verbal NIP and waiting for summons. got the summons 5 months later ( i was counting the days to the six month escape!), for a court appearance the following week. talk about organisation.....
don't forget the summons has to be issued within the six months only - doesn't matter when they actually send it to you.....
