I've just been flashed by a gatso doing about 52 in a 40. Anyone got any idea how likely i am to get a ticket? It was on a Sunday afternoon in Rosehill south London....

From my experience, chances of a ticket are about 1 in 10.

cheers. If the letter does drop thru the door, Do i have to inform a) my tiv insurer in which the deed was done and b) my audi insurer. If so, is it straight away or at renewal?

If you don't get a nip in two weeks, you are clear.

chances are fairly low, don't worry too much.

Good question. Most insurers require you to tell them of any change in circumstances (yours or cars) which might affect their risk. So I think technically you should tell both your insurers. But no-one ever does.

I would wait until (a) renewal or (b) conviction (i.e. not just the arrival of the NIP), whichever happens first.

Both NIPs I've received have been recorded delivery (or was it registered post - I can never remember the difference). So if you get one of those little cards through the door ("we tried to deliver an item requiring your signature") in the next couple of weeks, you could just "forget" to collect it from the Post Office.

so if I 'forgot' to collect it for two weeks, am I off the hook? Surely not...

No, you're not. I was being flippant, I guess.

The reason they send it recorded/registered is so they can prove you received it. (You can't use the "I didn't receive the NIP within 14 days" excuse when they chase you up.) If you don't collect it, it'll get returned to the sender (after 7 days I believe). I this happens, then I guess although they can't prove that you received it within 14 days (because you clearly didn't) they can prove that they delivered it within 14 days (because the Post Office will keep a record of the attempted delivery).

So, short answer, no - not collecting the NIP won't get you off the hook. But as has been said - your chances of getting a NIP are very low.

How many times did the Gatso flash? If once then it was a dummy unit, designed to frighten the pants off you and slow you down. If twice, then you WILL receive an NIP and name the driver form, followed by a provisional FPT. Where NIP is concerned, Police have to serve within 14 days on the registered owner. If that is not you, or you do not recive the NIP, service is proved if it was posted to the reg. owner within that time by Rec Delivery or Reg Post. Hope that helps.

One positive note - you won't receive an NIP IF the film in the camera had run out.

Just a quick note on speeding. This is one of a very few offences that require corroboration. That is why there are 2 photos taken on Gatso systems, the first backs up the second. Corroboration can be also one cop and a mechanical device, i.e. calibrated speedometer, laser gun, muniquip,VASCAR etc. Be aware that 2 cops estimating a speed independently is accepted by the courts. Useful if the speeder is coming the other way!!
The law accepts that Police officers are experts on
1. Drunkeness
2. Speed
