Variable limits are just the latest scam to boost the speeding tax take. I believe on these threads it is customary for brakists to attack the op irrespective, but in amongst the nonsense sometimes useful advice can be found from legitimate posters with experience working in the field. Unfortunately the challenge is sorting through the bullst.

I recently received a 'Notice of Intended Prosecution'' for the alleged offence of ''Exceed a variable speed limit - automatic camera device'', speed was allegedly 46mph and the speed limited at the time was reduced to 40mph on the M1 motorway.

The variable speed limits changed throughout the journey, from the national speed limit of 70 and all the variations in between (60, 50, 40 and maybe even 30 !)

The reduction in speed appeared to be due to road works on the motorway, it was around 04:00am when the traffic volume was low.

The speed adjustments were prevalent through out the journey and I guess lapse of focus when the speed re-adjusted for what felt like the 100th time, though part of me thinks I was within the speed limits and not sure how accurate the cameras were, were the speed limits readjusted just before I passed through a camera, I cant be sure.

Just wanted to see what you guys thought and if anyone has been in a similar situation. Thanks a
The best thing you can do is to lodge an appeal and present your evidence and see what comes. With no photo sent to you as yet but having received the NIP means they were at least able to locate you as the RK from your plate and will, if asked, provide you with photographic evidence if you request it.

What's your record like? You might get "just" 3 points and £100 or a Speed Awareness Course but unless you can prove beyond reasonable doubt or provide exceptional mitigating circumstances it is what it is. THere's a PH'er, agtlaw, that although i haven't used in the past always comes highly recommended.

What kind of appeal are you thinking? That means pleading NG then going to court. Then you'll miss the chance of a SAC or an FPN. Do you think that's sensible advice for the OP?

My sincere apologies Bert, i guess you're right and I don't know the ins and outs of any appeal nor the imminent circumstances that might arise as part of any appeal or action other than guilty. Which, i guess the OP is on the face of it.

I also notice that i managed to quote the OP sometime in between them starting the thread and a deletion. OP, apologies - even if i delete mine it has been re-quoted above.

It may be good advice, particularly if he can “prove” he was in another member state and therefore not driving. Damn au pair taking the car out again who has long since returned to Romania?

Basically this variable limit nonsense has got even more out of hand than the insane 20 limits! Fight every ticket to the end, never just roll over to the anti car eternal war on the motorist train and take their bullst.

These variable speed limits are just nuts at the moment. In recent months Ive had numerous incidents of them jumping to 60 then 50 then 60 then 40 then 50 on consecutive gantries for seemingly no reason. On a few occasions as I’ve been stuck between HGVs I have almost fallen foul of the slippery bds myself.

The responses the OP wanted weren't forthcoming here, either:

So MSE is also populated with absolute s? Driving the poor bd to the brink of suicide? No matter at least on an enthusiast motoring site you'd expect more willingness to fight the nonsense speeding taxes?

Oh. Wait...

The difficulty I see with that strategy is that the police can, more often than not, prove quite conclusively that the offence has been committed (which, more often than not, it has).

OP - if you are suicidal please reach out for some help asap via Samaritans or similar.

Let’s be honest, nobody is suicidal over 46 in a 40 in isolation so please reach out to somebody and try and address the root cause of this.

Take car buddy.

But if you're going to take the car, be observant of speed limits.

I wish I could say I’d made that typo on purpose to set up your brilliant reply but sadly I can’t!

Good work 😂
